What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Uzbekistan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

How to get your Tax Residency Certificate

You're an Indian in Uzbekistan. India needs proof. Here's the workflow from Uzbekistan, documents, portal, timeline, the lot.

Step-by-step for Indians in Tashkent

Apply to the Tax Committee under the Cabinet of Ministers for an official certificate confirming that you are an Uzbek tax resident. Apply online at my.soliq.uz or the unified government services portal (my.gov.uz), logging in with your PINFL or taxpayer number (TIN) and password, or in person at a Public Services Centre. Foreign nationals attach a passport copy, a residence permit if they have one, and a visa or other proof of their days in Uzbekistan. The service is free, and the Tax Committee issues a QR-coded electronic certificate within 3 working days. Residency itself follows Article 30 of the Tax Code: more than 183 days in Uzbekistan in any 12-month period that starts or ends in the tax year, or fewer days but more than in any other country. A newcomer can apply for resident status early by showing a long-term employment contract. Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank. India and Uzbekistan are both parties to the Apostille Convention, so if the bank wants a legalised copy, an apostille is enough, no embassy attestation.

Things Uzbekistan NRIs should know

Pitfalls we've seen Indians in Tashkent face

We work with the Indian community in Uzbekistan every day. These are the traps that cost real money.

Reclaim the 20 points above 10% through an Indian income tax return. Without Form 41 and tax residency certificate (TRC), banks deduct 30% tax deducted at source (TDS) on Non-Resident Ordinary (NRO) interest. Uzbekistan credits at most 5% if taxable there, nothing if its bank deposit exemption applies.

Claim credit using Indian tax proof for dividends and deposit interest taxable in Uzbekistan. Article 381 of the Uzbek Tax Code taxes residents' taxable interest and dividends at 5%. India can keep up to 10% under the treaty; credit cannot exceed Uzbek tax. Expect India's 10% as the cost.

Prepare Indian Form 16A and your tax credit statement before the 1 April declaration deadline. Article 342 of the Tax Code requires proof that foreign tax was paid, such as a certificate from the foreign tax authority. Any foreign-language document needs an Uzbek translation.

Separate fund units from shares. Article 14(6) taxes Indian mutual fund and exchange-traded fund unit gains only in Uzbekistan, at 12%. Article 14(5) keeps listed Indian shares taxable in India. Mixing them up can leave tax deducted at source (TDS) unclaimed on units or understate tax on shares.

Confirm whether Indian deposits qualify before filing. Article 378 of the Tax Code exempts bank deposit interest, without specifying Indian deposits. If covered, your Indian fixed deposit interest has no Uzbek tax or credit. India's tax is then your only tax, so reducing it to 10% matters.

Students still need a tax residency certificate (TRC) and Form 41 for 10% on Indian deposit interest. Article 21 exempts Indian students' maintenance and study payments from abroad from Uzbek tax, plus related earnings up to US$700 a year, for at most three consecutive years.

Count your days to establish whether Indian income must be declared in Uzbekistan. Residency starts after more than 183 days in any 12 months, or fewer days if you stayed longer in Uzbekistan than anywhere else. Trips abroad under six months for treatment or study do not break the count.

Only beneficial owners qualify for 10% caps. Check the arrangement's purpose too. Uzbekistan has not signed the Organisation for Economic Co-operation and Development (OECD) multilateral instrument. The 2012 Protocol added Article 28B, denying benefits where obtaining them was a main purpose of an arrangement.

Questions from Uzbekistan NRIs

Everything Indians in Tashkent ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Uzbekistan have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Tashkent don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.
