India-Ukraine treaty caps: interest 10% (Article 11), portfolio dividends 15% (Article 10). Article 13(6) reserves Ukraine-taxed ordinary mutual fund unit gains for Ukraine alone. What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Ukraine that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Things Ukraine NRIs should know

Pitfalls we've seen Indians in Ukraine face

We work with the Indian community in Ukraine every day. These are the traps that cost real money.

Keep Indian withholding within 10%. Ukraine credits Indian tax against personal income tax (18% on interest, 9% on dividends), never the 5% military levy. Non-Resident Ordinary (NRO) interest gets the 10% credit against 18%; the levy remains payable. Withholding above 10% is difficult to credit.

Arrange apostilled proof before your Ukrainian declaration is due. PwC's summary requires an official foreign-tax-authority certificate for credit. Bank tax deducted at source (TDS) certificates alone may be insufficient. Prepare your Indian income tax return (ITR), Form 26AS and TDS certificates, and arrange the apostille.

Budget for Ukrainian tax on Non-Resident External (NRE) interest. It is exempt in India, but Ukraine taxes this foreign income at 18% plus the 5% levy. There is no credit because India withheld nothing.

Declare gains in Ukraine to support Indian claims. Article 13(6) reserves ordinary Indian mutual fund/exchange-traded fund (ETF) gains for Ukraine if taxed there. Multilateral Instrument (MLI)-amended Article 13(4) permits Indian tax on trusts/funds with over 50% Indian immovable-property value in 365 days before sale. Article 13(5) keeps listed shares India-taxable.

Check residence after 2022. Ukraine tests place of abode, centre of vital interests, 183 days in the calendar year, then citizenship, in that order. Indian nationals settled elsewhere may lose residence. A State Tax Service of Ukraine (DPS) certificate for the wrong year or outdated status cannot support treaty claims.

Check your Ukrainian bank's limits before funding Indian investments. Martial-law controls under National Bank of Ukraine (NBU) Resolution 18 of 24 February 2022 cap individuals' monthly foreign-currency purchases and payments abroad. From 11 August 2026, NBU Resolution 90 sets main caps at UAH 200,000 monthly per bank.

Keep dated interest-credit and redemption records. Law No. 4835-IX (April 2026) retains the 5% levy until 31 December of the third calendar year after martial law ends. For annually declared foreign income, 1.5% applied to receipts through 31 December 2024; 5% applies to accruals from 1 January 2025.

Questions from Ukraine NRIs

Everything Indians in Ukraine ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Ukraine have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Ukraine don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
