Kazakhstan taxes worldwide income; its 1996 treaty's Article 24 caps Indian tax credits at Kazakh tax. Article 11's 10% interest tax is fully credited; without Form 41 and a State Revenue Committee tax residency certificate, banks withhold 30%. Reclaim 20 points in India. Article 13(6) taxes Indian mutual fund gains only in Kazakhstan. Almaty finance manager, ₹18L fixed deposits: about ₸272,000 yearly; up to five past years recoverable through condonation.

Where Kazakhstan NRIssave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
3 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Kazakhstan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Kazakhstan NRI's story
Based on The Indian community is small, with many students. A large share of the roughly 8,000 Indians in Kazakhstan study medicine at universities such as Astana Medical University and Semey Medical University. A smaller community of working professionals and traders lives mainly in Almaty and Astana., the kind of people in the Indian community in Kazakhstan.

Step-by-step for Indians in Almaty
Apply to the State Revenue Committee of the Ministry of Finance for a certificate confirming Kazakh tax residency. File online through egov.kz or your taxpayer personal account, signed with an electronic digital signature (EDS), or on paper at a Public Service Centre or your local tax office. Foreign nationals attach notarised copies of the passport pages, including the pages with Kazakh entry and exit stamps, plus the visa or other migration documents proving their stay. The eGov service is free and runs within 2 working days of submission. Pair it with Form 41 (formerly Form 10F) at your Indian bank. Kazakhstan and India are both Apostille Convention parties, so if the bank asks for a legalised copy, an apostille is enough, no embassy attestation.

Things Kazakhstan NRIs should know
Pitfalls we've seen Indians in Almaty face
We work with the Indian community in Kazakhstan every day. These are the traps that cost real money.
Reclaim excess withholding in India. Article 24(2) caps Kazakhstan's credit at Kazakh tax on the same income. Interest faces 10%; without Form 41 and a tax residency certificate (TRC), banks withhold 30%. Kazakhstan cannot credit 20 of those 30 points. Recovering them requires an Indian refund claim.
Separate fund units from shares. Article 13(6) taxes Indian mutual fund and exchange-traded fund units' gains only in Kazakhstan: 10% (15% above 8,500 MCI). Article 13(5) keeps listed Indian shares taxable in India. Confusion leaves Indian tax deducted at source (TDS) unclaimed on units or understates tax on shares.
Declare Non-Resident External (NRE) fixed deposit interest in Kazakhstan. It is exempt in India. Kazakh residents pay tax on worldwide income: 10% (15% above the annual 8,500 MCI band). No credit is available because India took no tax.
Prepare Indian tax paperwork early. PwC says Kazakhstan requires a certificate of foreign income and tax paid, issued or certified by the foreign tax authority, apostilled, with a notarised Kazakh or Russian translation, when filing by 15 September. A bank's tax deducted at source certificate alone may not satisfy inspectors.
Check student relief. Article 20 exempts Indian students resident in India immediately before arrival from Kazakhstan tax on Indian maintenance and education remittances and limited study-related earnings, for at most seven consecutive years from first arrival. Indian deposit interest still needs a tax residency certificate and Form 41 for 10%.
Check treaty eligibility. The 2017 Protocol added Article 28A, denying benefits where obtaining them was a main purpose of an arrangement. Only beneficial owners receive benefits. The Protocol also deleted the most-favoured-nation clause, so a lower rate from another Indian treaty cannot apply.
Count arrival and departure days in any rolling 12-month period for the 183-day test. Below 183 days, Kazakhstan may still apply centre of vital interests: citizenship or residence permit, family in Kazakhstan, and an available home. This matters when splitting time between Almaty and India.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
