Istanbul is home now. Your Indian savings still need care.
Under the 1995 India-Türkiye treaty, tax deducted at source (TDS) is capped at 15% on Non-Resident Ordinary (NRO) interest (Article 11) and 15% on dividends (Article 10). Your bank needs a mukimlik belgesi and Form 41 (formerly Form 10F); otherwise, it deducts 30%. Law 7582 exempts qualifying arrivals' Indian income without Turkish credit. For an Istanbul software engineer with ₹30L in fixed deposits, the gap is about ₺18,600 yearly.

Where Turkey NRIssave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
4 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Türkiye that caps the tax rate on your Indian income. For example, interest is capped at 15% instead of 30%. The difference is legally yours to claim back.

Based on About 4,200 people form the community, mostly Indian citizens, according to the Ministry of External Affairs (MEA) 2026 count. MEA's bilateral brief describes a concentration in Istanbul's commercial firms, banks and information technology (IT) companies, alongside project engineers hired by Turkish companies and university lecturers, especially in IT faculties. Ankara has the Embassy. The Istanbul Consulate covers Istanbul and 13 other western provinces., the kind of people in the Indian community in Türkiye.

Türkiye taxes his worldwide income. He holds ₹30L in Non-Resident Ordinary (NRO) fixed deposits and ₹4L in NRO savings. He is redeeming ₹3L from his ₹15L Indian equity mutual fund portfolio. Step-by-step for Indians in Istanbul
Ask for a mukimlik belgesi (certificate of residence). Under GİB's double tax treaty circular No. 3 of 20 December 2013, applications from foreign nationals go centrally to the Gelir İdaresi Başkanlığı (GİB), not to a local tax office. Include the foreigner petition, the questionnaire for foreigners (both annexed to the circular) and a copy of your Turkish residence permit. You can also apply online through the İnteraktif Vergi Dairesi (ivd.gib.gov.tr). Ask for the English version, which GİB issues for treaty purposes, and give it to your Indian bank with Form 41 (formerly Form 10F). Türkiye and India are both parties to the Hague Apostille Convention, so an apostille works if a bank wants it legalised.

Things Turkey NRIs should know
Pitfalls we've seen Indians in Istanbul face
We work with the Indian community in Türkiye every day. These are the traps that cost real money.
Apply to your tax office for İstisna Belgesi by your residency year's end; for November or December, by the following February's end. Law No. 7582 exempts qualifying Indian income without Turkish return reporting. Türkiye cannot credit Indian tax. Use treaty withholding at 15% or reclaim excess through an Indian return.
Check that your bank uses 15%. Article 11 reserves 10% for loans granted by a bank or financial institution. Banks sometimes choose incorrectly. Without a tax residency certificate (TRC) or Form 41 (formerly Form 10F), they deduct 30% on Non-Resident Ordinary (NRO) fixed deposits.
Check whether your assignment makes you resident. Income Tax Law Article 4 covers domicile in Türkiye or stays over six months per calendar year. Article 5 excludes foreigners on specific temporary jobs or assignments, even after six months. Short-term project engineers cannot obtain a mukimlik belgesi or treaty rates.
Keep Form 26AS and tax deducted at source (TDS) certificates. Without Law 7582 relief, Türkiye credits Indian tax under Article 22(3) on dividends, interest, royalties and Article 13(6) gains, capped at Turkish tax on that income. Rent and Indian property gains are exempt but can raise your Turkish income's rate.
Apply centrally to Gelir İdaresi Başkanlığı (GİB) for your mukimlik belgesi, with the foreigner questionnaire and residence permit copy. Local offices serve Turkish citizens. Allow time before your bank's next interest credit; request English. Hague Apostille membership (Türkiye since 1985, India since 2005) allows legalisation if your bank requires it.
Plan for contributions in both systems when posted from India. Türkiye is absent from the Ministry of External Affairs (MEA) list of India's social security agreements. The Employees' Provident Fund Organisation (EPFO) cannot issue a certificate of coverage. Indian service cannot count towards Turkish pension eligibility.
Claim private pension relief with your Indian payer. Under Article 18, an Indian private pension or annuity for past employment is taxable only in your residence state. A Turkish resident can claim full relief. Government-service pensions follow Article 19.
Check domestic law in each country for family farmland income. Paragraph 6 of the Protocol excludes agricultural income earned by a resident of one state from activities in the other. Family farmland income in India therefore has no treaty protection.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
EPF withdrawal exemption: continuous service
Right now: 5 years of continuous service
Where it works differently
- Service is under 5 years
- Four components are taxed separately: employer contribution and its interest as salary, employee contribution previously claimed under 80C reversed, and interest on employee contribution as other sources.
- Rule 8 of Part A of the Fourth Schedule.
- Employment ended for reasons beyond the employee's control
- The 5-year condition is relaxed.
- Proviso to Rule 8.
- The account is inoperative
- Interest continues to accrue and is taxable once the member leaves service.
- Settled position; a live issue for NRIs with dormant accounts.
Commonly got wrong
- EPF withdrawal is always tax-free. Only after 5 years of continuous service. An EPF withdrawal is tax-free only after five years of continuous service. Below five years, four separate components become taxable in different heads.
EPF interest that becomes taxable on high contributions
Right now: Interest on employee contributions above Rs 2,50,000 a year is taxable (Rs 5,00,000 where the employer makes no contribution)
Where it works differently
- The member is an NRI with a dormant account
- Interest continues to accrue, and an account becomes inoperative after 36 months without contribution, at which point the interest is taxable in India.
- EPF Scheme rules plus settled tax treatment.
- The member has left India
- Indian tax on that interest still applies as India-sourced income, and the residence country may tax it too.
- s.9 read with the relevant treaty.
Commonly got wrong
- All EPF interest is tax-free. Interest on employee contributions above Rs 2.5 lakh a year has been taxable since FY 2021-22.Interest is tax-free up to Rs 2.5 lakh of employee contribution a year (Rs 5 lakh where the employer does not contribute). Above that it is taxable.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
