Tax representation for Gulf NRIs

The officer is on leave.
Again.

You flew to India for one meeting. You're still waiting outside the AO's room at 4 pm. Tomorrow's flight back to UAE is at 7. This is the 3rd visit in six months.

There's a better way. It's called Section 288.

The problem

Every NRI we meet has the same story.

A small tax matter turns into three trips to India. Here's how.

Trip 1

You fly from UAE because the AO said to come. You arrive Monday. Officer's on leave till Friday. You leave without meeting anyone. Flight from UAE + a couple of hotel nights + lost work days: around ₹30,000 gone.

Trip 2

Three months later, you try again. This time the officer shows up. But your file is with the old range. Jurisdictional transfer in progress. Come back in 6 weeks, they say.

Trip 3

The faceless portal wants you to upload a reply. You try from home in Dubai. Aadhaar OTP doesn't work (no Indian mobile). DSC registration fails. Net-banking login only works for SBI, and your SBI account is frozen because address is abroad. You fly again.

Trip 4, 5, 6

Each one is about the same. A missing paper. A transferred officer. A portal error. Meanwhile the demand sits there, interest ticking at 1% a month.

The math for a Gulf NRI: By trip 4, you've spent roughly ₹1.2 lakhin travel alone. And the case still isn't closed. Most NRIs give up around this point and just pay the demand, even when it's wrong.

The fix

Section 288. Short version.

The Income-tax Act, 1961, Section 288 says: an assessee may be represented by an Authorized Representative. Usually a practicing Chartered Accountant.

You sign one document. A Power of Attorney, notarized where you live and attested at the Indian Consulate. That's it. From that day, our CA stands in for you at every office, every hearing, every portal login.

You don't fly. You don't log in. You don't wait outside a tax office in Mumbai in June.

We become your AR

Under Section 288, our CA is officially on record. We receive every notice, every order, every communication.

Full portal access

Via our DSC and your e-Proceedings authorization. Every reply goes in on time, every time.

We show up physically

AO hearings, ITAT benches, Form 13 verification, jurisdictional transfers. We attend. You relax.

What we represent on

Six areas. One phone call.

Section 143(2), 142(1)

AO scrutiny and inquiries

Full scrutiny assessments. Documentation requests. Source-of-funds explanations for NRO credits and property purchases. We draft, file, and attend.

Section 197, Form 13

Form 13 / Lower TDS

Property sale coming up? Rental income? Capital gains? A lower-TDS certificate can save you lakhs. We file on TRACES, attend the physical verification, and chase till it's issued.

CIT(A), Form 35

First appeals (faceless)

Form 35 within 30 days of the order. Drafting the grounds of appeal. Paper book. Video-conference hearing representation at the National Faceless Appeal Centre.

Section 253, Form 36

ITAT — physical hearings

Second appeals at the tribunal. Mumbai, Delhi, Bangalore, Chennai, Ahmedabad. Still fully physical. We brief counsel, file the paper book, attend the hearing. You never board a flight.

Section 144C

DRP for international tax

Transfer pricing cases and foreign company cases. 30 days to object. 9-month panel proceeding. Straight route to ITAT after. We handle the full track.

Section 154, Section 220(6)

Old demands and stays

That phantom 10-year-old demand eating your refund? Section 154 rectification. Stay of recovery under 220(6). Done before the next adjustment runs.
