Where Tajikistan NRIssave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
2 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Tajikistan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

He holds ₹12L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings. He is redeeming ₹2L from a ₹9L Indian equity mutual fund portfolio. Step-by-step for Indians in Dushanbe
Your Tajik tax residence is set for each calendar year (Tax Code Article 14(5)). Ask the Tax Committee under the Government of Tajikistan, the tax authority where you are registered, for a certificate confirming that you were a resident for the year. The Tax Committee has not published an application form, fee or processing time for this certificate. Its 2025 service standard lists only treaty services for non-residents, so confirm the procedure at your local tax office. The treaty's competent authority for Tajikistan is the Ministry of Finance (Article 3). Give the certificate to your Indian bank with Form 41 (formerly Form 10F). India and Tajikistan are both in the Apostille Convention, and India did not object to Tajikistan joining, so an apostille should be enough if the bank asks for a legalised copy.

Things Tajikistan NRIs should know
Pitfalls we've seen Indians in Dushanbe face
We work with the Indian community in Tajikistan every day. These are the traps that cost real money.
Submit Form 41 with a tax residence certificate (TRC): India takes 10%, Tajikistan 5 points. Tajik non-salary tax is 15% (Tax Code Article 183(3)). Otherwise: 30% withholding; 15% credit limit (Article 220(3)). Excess gets no credit, refund or carry-forward (Article 220(7)). Reclaim above-10% interest withholding only through an Indian return.
Budget for Tajik tax on Non-Resident External (NRE) interest. It is tax-free in India. Tajikistan taxes residents on income from all sources (Article 181(2)). With no Indian tax paid, there is no credit. A Tajik resident pays the full 15%.
File yourself in Dushanbe by 1 April of the following year. Article 241(4) covers residents with income untaxed at source in Tajikistan, and residents receiving overseas income with foreign bank balances above 2,000 calculation indicators. Indian banks are not Tajik tax agents and withhold nothing for Tajikistan.
Keep proof for your credit. Article 220(6) requires payment within two years after the tax year ends and proof from the foreign tax authority for your tax office. Keep tax deducted at source (TDS) certificates, Form 131 (formerly Form 16A), and your Indian return.
Claim the fund exemption at your bank or in your Indian return. Indian mutual fund and exchange-traded fund (ETF) unit gains are taxable only in Tajikistan under treaty Article 13(5). Listed Indian share gains remain taxable in India under Article 13(4). Do not apply the exemption to shares.
Count across years. Residence requires more than 182 days in Tajikistan within any 12-month period starting or ending in the year (Article 14(2)). In first and last years, residence starts on arrival or ends on departure. Long breaks at home in India do not reset the count.
Claim student relief under treaty Article 21. Indian students in Tajikistan receive overseas maintenance, education or training funds and study-related earnings tax-free for at most six consecutive years from first arrival. Indian Non-Resident Ordinary (NRO) interest relief requires Tajik residence, Form 41 and a Tajik tax residence certificate (TRC).

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
