Built for Kyrgyzstan NRIsSave 20% on interest

Studying in Bishkek, saving in India. We handle the tax.

India-Kyrgyz treaty Articles 10 and 11 cap India’s interest/dividend tax at 10%; Article 13(6) reserves Indian mutual fund gains for Kyrgyzstan. Foreigners need residence permits for worldwide taxation and treaty residence. State Tax Service tax residency certificates (TRC) and Form 41 (formerly Form 10F) cut bank withholding from 30% to 10%. A Bishkek doctor’s ₹15L fixed deposits save about 40,500 сом yearly. Reclaim past excess through Indian returns.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Kyrgyzstan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Rajesh

He holds ₹15L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings. He is redeeming ₹1.5L from an ₹8L Indian equity mutual fund portfolio. His bank still withholds the full 30% on interest because he has never filed Form 41 (formerly Form 10F) with a Kyrgyz tax residency certificate (TRC).

How to get your Tax Residency Certificate

You're an Indian in Kyrgyzstan. India needs proof. Here's the workflow from Kyrgyzstan, documents, portal, timeline, the lot.

Step-by-step for Indians in Bishkek

The State Tax Service (GNS) confirms Kyrgyz tax residence for individuals; the function moved to it from the Ministry of Economy. Download the application for confirmation of tax status from sti.gov.kg (Tax agreements section), and file it at the GNS central office in Bishkek. Foreigners attach a passport copy, documents proving temporary or permanent residence in Kyrgyzstan, and a border-crossing record from the Border Service. Attach your residence permit: without one you are taxed only on Kyrgyz-source income and may not count as a treaty resident under Article 4(1). Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank. India and Kyrgyzstan are both parties to the Apostille Convention, so if the bank wants a legalised copy, an apostille should be enough.

Things Kyrgyzstan NRIs should know

Pitfalls we've seen Indians in Bishkek face

We work with the Indian community in Kyrgyzstan every day. These are the traps that cost real money.

Check your residence permit before paying for a tax residency certificate (TRC). Without one, foreigners pay tax only on Kyrgyz-source income (Tax Code Article 186(1)(3)), excluding treaty residence under Article 4(1). A Bishkek work permit alone may therefore lead your Indian bank to correctly refuse the 10% rate.

Recover excess withholding through an Indian income tax return. Permit holders pay 10% Kyrgyz tax on Indian interest; Tax Code Article 205 and treaty Article 23(1) cap credit at 10%. Without Form 41 (formerly Form 10F) and a tax residency certificate (TRC), 30% withholding leaves 20 points uncredited.

Indian Non-Resident External (NRE) and Non-Resident Ordinary (NRO) interest is taxable at 10% for permit holders. Article 191(7)(1) exempts deposit and account interest, but Tax Code Article 4 defines banks as licensed by the National Bank of the Kyrgyz Republic. NRE interest has no Indian tax to credit.

File Form 41 (formerly Form 10F) with a tax residency certificate (TRC) to cut tax deducted at source (TDS) from 20% to 10%. Article 191(7)(10-1) exempts foreign-company dividends for Kyrgyzstan's resident foreigners, with or without residence permits. Kyrgyzstan absorbs no Indian dividend tax; reducing Indian withholding is the only lever.

Separate Indian fund gains from share gains. Article 13(6) taxes Indian mutual fund and exchange-traded fund (ETF) unit gains only in Kyrgyzstan. Article 13(5) leaves listed Indian shares taxable in India. Confusing them can leave tax deducted at source (TDS) on fund units unclaimed or understate Indian share tax.

Income from payers without Kyrgyz tax-agent status, including Indian banks, belongs on the calendar-year Unified Tax Declaration (Article 106(2)(5)). File by 1 May next year for most individuals; 1 April for some categories. Cabinet of Ministers sets foreign-credit procedures. Keep Indian tax deducted at source (TDS) certificates and returns.

Count days carefully if you spend long summers in India. The 183-day test covers any 12 consecutive months ending in the tax year (Tax Code Article 24(2)). Counting only the calendar year can give you the wrong result.

Student relief has limits. Treaty Article 20 exempts Indian students resident in India immediately before arrival on overseas maintenance and education money and limited study-related earnings in Kyrgyzstan, for at most five consecutive years from first arrival. Indian fixed deposit interest faces India's rates unless you qualify for the treaty.

Questions from Kyrgyzstan NRIs

Everything Indians in Bishkek ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Kyrgyzstan (Kyrgyz Republic) have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Bishkek don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
