Tbilisi is home now. Your Indian savings still need care.
Georgia exempts Indian interest and gives no Indian tax deducted at source (TDS) credit. The 2011 India-Georgia treaty caps non-resident ordinary (NRO) interest at 10% (Article 11) and dividends at 10% (Article 10). Without a Revenue Service tax residency certificate (TRC) and Form 41 (formerly Form 10F), banks deduct 30%; reclaim excess through an Indian return. For a Tbilisi hotel manager with ₹12L fixed deposits (FDs), that's about ₾1,090 annually.

Where Georgia NRIssave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
2 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Georgia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Neha
37, is an operations manager at an international hotel in Tbilisi. She has been a Georgian tax resident for four years on a residence permit. She holds ₹12L in non-resident ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings. She is redeeming ₹1.5L from her ₹6L Indian equity mutual fund portfolio. Her bank deducts 30% on interest because she has never filed Form 41 with a Georgian tax residency certificate (TRC). Hypothetical example.

Step-by-step for Indians in Tbilisi
Apply to the Revenue Service of Georgia for a certificate confirming your Georgian tax residence for the tax year your Indian income falls in. The rs.ge online account is the usual route, but confirm the current steps with the Revenue Service. Keep proof of your days in Georgia (passport stamps, residence permit) and make sure your name and address match your Indian bank KYC. Give the certificate to your Indian bank with Form 41 (formerly Form 10F) before the next interest credit. Georgia and India are both parties to the Hague Apostille Convention, so if the bank wants a legalised copy, an apostille is enough, with no embassy attestation.

Things Georgia NRIs should know
Pitfalls we've seen Indians in Tbilisi face
We work with the Indian community in Georgia every day. These are the traps that cost real money.
Claim 10% at your bank; reclaim excess through an Indian income tax return. Under Article 82(1)(u) of the Tax Code, Georgia exempts non-Georgian-source Indian bank interest. Without a tax residency certificate (TRC) and Form 41, banks deduct 30%, with no Georgian credit.
Check residence before requesting a tax residency certificate (TRC). Georgia's 183-day test counts 183 days in any continuous 12-month period ending in the tax year. Part-days count fully. Absences for treatment, leisure, business trips or education count; other absences and Georgia stays solely for treatment or leisure do not.
Separate your accounts. Non-resident external (NRE) interest is exempt in India and untaxed in Georgia because it is not Georgian-source. India taxes non-resident ordinary (NRO) interest at 10% with a tax residency certificate (TRC) and Form 41, or 30% without them.
Confirm fund treatment with a chartered accountant (CA) before claiming relief. Indian mutual fund and exchange-traded fund (ETF) unit gains fall under Article 13(6): India cannot tax Georgia residents; Georgia exempts non-Georgian-source gains. Listed Indian shares remain taxable in India at 12.5% under Article 13(5).
Check student relief. Article 20 exempts Indian students in Georgia solely for education: India-sent maintenance, education or training funds; directly study-related Georgian job pay. Relief lasts up to six consecutive years from first arrival. Indian non-resident ordinary (NRO) interest needs a tax residency certificate (TRC) and Form 41 for 10%.
Expect tax residency certificate scrutiny after tax-led moves with little time in Georgia. Article 30 denies benefits for residence or transactions with a main treaty-benefit purpose. Multilateral Instrument (MLI) Article 7(1), in India from 1 April 2020, adds a principal purpose test unless benefits fit the provision's object and purpose.
Use a Georgian apostille if your bank requests a legalised tax residency certificate (TRC); Indian embassy attestation is unnecessary. Georgia joined the Hague Apostille Convention in 2007; India in 2005. Germany and Greece withdrew their objections to Georgia's accession. India never objected.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
