Built for Belarus NRIsSave 20% on interest

Medicine in Minsk, savings in India. We handle the tax.

Belarus taxes residents' worldwide income, mostly at 13%. Its 1997 India treaty caps interest tax at 10% (Article 11). Without Form 41 and a Ministry of Taxes and Duties tax residency certificate, banks withhold 30%; reclaim 20 points in India. Article 13(6) reserves Indian mutual fund gains to Belarus. For a Minsk trade representative's ₹15L fixed deposits: about BYN 1,430 yearly, with up to five past years recoverable through condonation.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Belarus that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

How to get your Tax Residency Certificate

You're an Indian in Belarus. India needs proof. Here's the workflow from Belarus, documents, portal, timeline, the lot.

Step-by-step for Indians in Minsk

Ask the inspectorate of the Ministry of Taxes and Duties (MTD) where you live for a certificate confirming Belarusian tax residency. This is administrative procedure 18.9, free of charge: bring your passport and proof of where you lived during the year, such as a residence permit and work or study records. It takes 5 working days, or up to one month if the inspectorate needs checks or documents from other bodies. You can also order it online through the e-pasluga.by portal and download it as an electronically signed document. An electronic certificate carries a unique number that anyone, including your Indian bank, can check on the MTD's online certificate verification service at nalog.gov.by; a paper certificate carries the inspectorate's seal. The certificate confirms residency for a stated tax period, so request one for each year you claim treaty rates. Pair it with Form 41 (formerly Form 10F) at your Indian bank. Belarus and India are both Apostille Convention parties, so if a bank asks for a legalised paper copy, an apostille should be enough.

Things Belarus NRIs should know

Pitfalls we've seen Indians in Minsk face

We work with the Indian community in Belarus every day. These are the traps that cost real money.

Claim an Indian refund for excess interest withholding. Without Form 41 and a tax residency certificate (TRC), banks withhold 30%, versus Article 11(2)'s 10% cap: 20 points excess. Article 24(3) limits credit to Belarusian tax on that income; about 3 points (13% less 10%) remain payable in Belarus.

Separate fund units from shares. Article 13(6) makes Indian mutual fund and exchange-traded fund unit gains taxable only in Belarus. Article 13(5) keeps listed Indian shares taxable in India. Mixing them up can leave tax deducted at source unclaimed on units or understate tax on shares.

Check student exemption dates. Article 20 exempts Indian students' maintenance and education remittances from Belarusian tax for only five consecutive years from first arrival. For 10% interest tax on your Non-Resident Ordinary (NRO) account, provide a tax residency certificate (TRC) and Form 41.

Declare Non-Resident External (NRE) deposit interest in Belarus; India exempts it. The Ministry of Taxes and Duties requires residents to declare foreign-account interest. Article 24(4) treats tax spared by Indian incentives 'designed to promote economic development' as paid. The NRE exemption's eligibility is untested; do not assume credit.

Count your days in Belarus. Residence requires more than 183 days in a calendar year. Business trips and medical treatment abroad count towards this total; holidays abroad count only up to 60 days. File by 31 March and pay by 1 June of the following year.

Confirm Non-Resident Ordinary (NRO) refund/repatriation routes with Indian and Belarusian banks first. July 2025 European Union (EU) sanctions replaced 2022 Society for Worldwide Interbank Financial Telecommunication (SWIFT) restrictions, banning transactions with Belagroprombank, Bank Dabrabyt, the Development Bank, Belinvestbank and majority-owned subsidiaries. EU banks cap Belarusian nationals'/residents' deposits at EUR 100,000.

Use the individual dividend rate. Article 10(2) caps tax at 15%; 10% requires a company holding at least 25%. With Form 41, expect 15% withholding. The 10% rate quoted for many other European treaties does not apply to an individual.

Questions from Belarus NRIs

Everything Indians in Minsk ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Belarus have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Minsk don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
