Built for Lithuania NRIsSave 20% on interest

Vilnius is home now. Your Indian savings still matter.

Lithuania taxes worldwide income after 183 days or setting up home. The India-Lithuania DTAA (Double Taxation Avoidance Agreement) caps Indian interest tax at 10% (Article 11) and dividends at 15% (Article 10). Article 13(5) leaves mutual fund unit gains to Lithuania. For a Vilnius engineer with ₹25L in Non-Resident Ordinary (NRO) fixed deposits and a ₹6L fund redemption, savings are about €1,085 yearly.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Lithuania that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Lithuania NRI's story

Based on The Ministry of External Affairs (MEA) March 2024 brief puts this small, young community at about 7,000, mostly students in information and communications technology (ICT), engineering and life sciences at Lithuanian universities. Kaunas University of Technology and VILNIUS TECH historically enrolled the largest share. Graduates increasingly stay for information technology (IT) and engineering jobs in Vilnius and Kaunas, alongside professionals, business owners and their families., the kind of people in the Indian community in Lithuania.

Rohan (hypothetical)

31, is a data engineer in Vilnius. He came to Kaunas in 2019 for a master's at Kaunas University of Technology and stayed on. He has been a Lithuanian tax resident for 5 years. He holds ₹25L in Non-Resident Ordinary (NRO) fixed deposits (FDs), ₹4L in NRO savings and a ₹30L Indian mutual fund (MF) portfolio. He is redeeming ₹6L this year towards a flat deposit in Vilnius. His bank still deducts 30% on his FD interest because it has never received an FR0254. His asset management company (AMC) also withholds tax on fund-unit gains that Article 13(5) leaves to Lithuania.

Things Lithuania NRIs should know

Pitfalls we've seen Indians in Lithuania face

We work with the Indian community in Lithuania every day. These are the traps that cost real money.

Keep proof of Indian tax paid. Under Article 37 of the Lithuanian PIT Law (Personal Income Tax Law), interest and dividends receive capped credit; Indian rent and other taxed treaty income receive exemption. Keep Form 26AS, Tax Deducted at Source (TDS) certificates and your Indian Income Tax Return (ITR).

Reclaim excess Indian dividend tax through an Indian return. Article 10 caps individuals' tax at 15%; Lithuania's credit stops there. Indian registrars deduct 20% plus surcharge and cess unless they hold your FR0254 and Form 41 (formerly Form 10F).

Report taxable deposit interest on your Lithuanian annual return. Non-Resident External (NRE) fixed deposit interest is tax-free in India, leaving no Indian tax credit. Lithuania's EUR 500 annual exemption covers total bank deposit interest, including foreign-bank agreements concluded from 2014. The excess is taxable as worldwide income.

Graduates who stay on should check Lithuanian tax residence. Your Indian bank needs that year's FR0254 before applying Double Taxation Avoidance Agreement (DTAA) rates. Order it through Mano VMI. The State Tax Inspectorate (VMI) issues it within 5 working days.

Plan large Indian fixed deposit maturities or property sales with your Lithuanian tax band in mind. The 2026 reform introduced 20%, 25% and 32% bands (EUR 83,237 and EUR 138,729 for 2026). Your Indian income counts towards the total that sets your band.

Check your Indian bank's or sub-registrar's requirements before signing a power of attorney in Lithuania for an Indian property sale or bank mandate. Lithuania and India are parties to the Hague Apostille Convention, so apostille normally applies rather than embassy legalisation.

Check social security arrangements when your employer sends you between India and Lithuania. India has no social security agreement with Lithuania. You cannot use a certificate of coverage to stay in one scheme, as you could between countries with such an agreement.

Questions from Lithuania NRIs

Everything Indians in Lithuania ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Lithuania have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Lithuania don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Power of Attorney executed abroad: the stamping clock

Right now: Stamped in India within 3 months of receipt in India

Where it works differently

The country is a Hague Apostille Convention member
Notarise locally, then apostille. Otherwise it needs attestation by the Indian mission.
Two different routes; using the wrong one means a rejected document at the sub-registrar.
The 3 months lapse
Penalty stamping is required and the document may be questioned. Sub-registrars do check the receipt date.
Indian Stamp Act.
The PoA is meant to transfer the property itself
It cannot. A GPA does not convey title, per Suraj Lamp (SC, 2011). A PoA authorises someone to ACT for you, not to receive your property.
The commonest and costliest misunderstanding.

Commonly got wrong

  • A PoA can be used to sell the property to the holder. Suraj Lamp held GPA sales convey nothing. A PoA lets an agent act for you; it does not transfer ownership to them.A Power of Attorney lets someone sign on your behalf. It does not transfer the property to them. Only a registered sale deed does that.
