Built for Armenia NRIsSave 20% on interest

Studying in Yerevan, saving in India. We handle the tax.

Armenia taxes Indian interest; its credit stops at its own rate. The 2003 India-Armenia treaty caps tax on Non-Resident Ordinary (NRO) interest at 10% (Article 11) and dividends at 10% (Article 10). Your bank needs a State Revenue Committee residency certificate and Form 41 (formerly Form 10F); otherwise, 30% applies. Reclaim excess through an Indian return. For a Yerevan software engineer’s ₹10L fixed deposits, the excess is about ֏136,000 yearly.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Armenia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Karan

36, works as a software engineer at an information technology (IT) company in Yerevan. He has been an Armenian tax resident for three years on a residence permit. He holds ₹10L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹2L in NRO savings. He is redeeming ₹1.5L from a ₹5L Indian equity mutual fund portfolio. His bank still deducts 30% on interest because he has never filed Form 41 (formerly Form 10F) with an Armenian tax residency certificate (TRC). Hypothetical example.

Step-by-step for Indians in Yerevan

Apply online on the State Revenue Committee (SRC) e-services platform (e-services.src.am) for the "Certificate of Confirmation of RA Resident Status for an Individual who is a Foreign Citizen". You log in with Armenia's "YesEm" (I Am) electronic ID. The SRC lists the service as free, with a processing time of two working days. Ask for the year your Indian income falls in. Keep proof of your days in Armenia: arrival and departure days both count as full days. Make sure your name matches your Indian bank KYC. Give the certificate to your bank with Form 41 (formerly Form 10F) before the next interest credit. Armenia and India are both parties to the Hague Apostille Convention, so if the bank wants a legalised copy, an apostille is enough.

Things Armenia NRIs should know

Pitfalls we've seen Indians in Yerevan face

We work with the Indian community in Armenia every day. These are the traps that cost real money.

Use the 10% treaty rate. The State Revenue Committee (SRC) guide caps credit at Armenian tax: bank deposit interest 10%, other interest 20%. Without a tax residency certificate (TRC) and Form 41 (formerly Form 10F), deductions are 30%. Reclaim excess only through an Indian income tax return.

Check dividend treatment with an Armenian adviser before expecting full credit. Article 10 allows India to deduct up to 10%. The State Revenue Committee (SRC) guide lists Armenian dividend tax at 5% and caps the credit at Armenian tax, leaving a gap even at the treaty rate.

Declare income yourself if the payer is not an Armenian tax agent, including Indian banks. The April 2025 Tax Code amendment sets the reporting year 2025 window at 2 March to 1 November 2026. From reporting year 2026, it is 2 March to 1 July of the following year.

Keep Form 16A and annual tax statement (Form 26AS). For credit, the State Revenue Committee guide requires a foreign tax authority’s verified reference showing year and tax actually paid. For foreign income up to AMD 12 million, reference is waived for the 2023 reporting year and four years after it.

Check residence before using a tax residency certificate (TRC). Armenia treats you as resident for the whole calendar year if resident on any date: 183 days or more in Armenia, counting arrival and departure days as full days, or a home, family or work centred there.

Declare Non-Resident External (NRE) interest on your Armenian return. Armenia taxes residents’ foreign income, including this interest. It is tax-free in India, so there is no Indian tax to credit.

Confirm fund treatment with a chartered accountant. Article 13(6) exempts an Armenia resident’s Indian mutual fund and exchange-traded fund (ETF) unit gains in India. Article 13(5) keeps listed Indian shares taxable at 12.5%. The treaty’s limitation of benefits clause and Multilateral Instrument (MLI) principal purpose test both apply.

Payments from outside Armenia are exempt under Article 21 for Indian students there solely for education, covering maintenance, education or training for the course’s reasonable duration. Non-Resident Ordinary (NRO) interest needs a tax residency certificate (TRC) and Form 41 (formerly Form 10F) for India’s 10%.

Questions from Armenia NRIs

Everything Indians in Yerevan ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Armenia have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Yerevan don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
