Built for Albania NRIsSave 20% on interest

Tirana is home now. Your Indian income still counts.

Albania taxes residents' Indian interest at 15%. The 2013 India-Albania treaty caps Indian interest and dividend tax at 10% (Articles 11 and 10); India exempts Indian mutual fund units' gains (Article 13(5)). Without a residence certificate and Form 41 (formerly Form 10F), non-resident ordinary (NRO) interest faces 30%; Albania credits 15%. A Tirana hotel supervisor's ₹9.5L NRO deposits and savings plus fund redemption mean about ALL 17,800 excess yearly withholding.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Albania that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Step-by-step for Indians in Tirana

Individuals not registered as taxpayers apply on paper to Albania's General Directorate of Taxes (Drejtoria e Përgjithshme e Tatimeve), in person or by post. You qualify with more than 183 days in Albania in the calendar year, or by showing your centre of vital and economic interests is there. Send a written request explaining why you need the certificate, the residence certificate application form completed at Section B, a copy of your ID, the official border entry and exit record from the TIMS system to prove your days, and proof of a stable home (a property certificate or a registered rental contract). The tax office decides within 30 calendar days of registering your request, and the certificate covers the one tax year requested. Taxpayers registered with a tax number (NIPT) get it instantly on e-Albania. Then give the certificate to your Indian bank or fund house with Form 41 (formerly Form 10F) before the interest is credited.

Things Albania NRIs should know

Pitfalls we've seen Indians in Tirana face

We work with the Indian community in Albania every day. These are the traps that cost real money.

Check residence before claiming treaty rates. Seasonal coastal hotel and restaurant contracts can end before you pass 183 days in the calendar year. Without family, home and main income in Albania, you then do not qualify. Request the official TIMS border entry and exit record early for the tax office.

Apply early in the Albanian calendar year, before Indian bank credits interest. Without a tax number (NIPT), apply in person or by post, not e-Albania. Give the General Directorate of Taxes the written request, Section B form, identification, deed or registered lease and TIMS day count. Allow 30 calendar days.

Submit the residence certificate and Form 41 (formerly Form 10F) before interest is credited. Albania caps Indian tax credits at its own tax, country by country. On non-resident ordinary (NRO) interest, 30% withholding gets only 15% credit. Recover the other 15% through an Indian income tax return.

Declare non-resident external (NRE) interest in Albania. It is tax-free in India and taxable at 15% as investment income for Albanian residents. There is no Indian tax to credit. Article 24 has no tax-sparing clause treating Indian tax as paid.

Treat units and shares differently. Indian fund and exchange-traded fund (ETF) unit gains are taxable only in Albania at 15% under Article 13(5). Listed Indian shares face 12.5% under Article 13(4), credited against Albania's 15%. Show fund houses the treaty; reclaim excess unit withholding through an Indian return.

Claim India's 10% dividend cap under Article 10. Albania taxes dividends at 8% and will not credit the remaining 2%. Applying the cap still reduces India's 20% domestic withholding.

Check whether you must file in Albania by 31 March after each calendar year. Filing applies with gross income from all sources of ALL 1,200,000 or more, multiple employers in any month, or over ALL 50,000 of income not taxed at source. Indian interest usually falls in the last category.

An India-based employer posting staff to Albania cannot use an Indian certificate of coverage. India and Albania have no social security agreement; Albania is absent from the Ministry of External Affairs list.

Questions from Albania NRIs

Everything Indians in Tirana ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Albania have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Tirana don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
