Sofia is home now. Your Indian savings still count.
Bulgaria taxes residents’ worldwide income at 10%; Indian bank interest lacks the European Union/European Economic Area (EU/EEA) exemption. The 1994 India-Bulgaria treaty caps interest (Article 12) and dividends (Article 11) at 15%. Article 4 covers Bulgarian nationals; Indian passport holders in Sofia face 30%. Article 14(6) removes Indian tax on Bulgarian nationals’ mutual-fund gains. ₹25L Non-Resident Ordinary (NRO) deposits/savings plus ₹2L redemption saves about €480 yearly. Bulgaria exempts India-taxable rent/gains.

Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
3 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Bulgaria that caps the tax rate on your Indian income. For example, interest is capped at 15% instead of 30%. The difference is legally yours to claim back.

A typical Bulgaria NRI's story
Based on The community grew from about 700 in the Ministry of External Affairs (MEA)’s 2020 brief to 1,077 in January 2026. It includes professionals, small-business owners and several hundred Indian medical students in Sofia, Pleven, Plovdiv, Varna and Stara Zagora. The treaty serves Persons of Indian Origin (PIO) with Bulgarian citizenship, often long-settled doctors and business owners who first came as students., the kind of people in the Indian community in Bulgaria.
Hypothetical: Sunil
54, is an India-born physician. He came to Pleven to study medicine, stayed and took Bulgarian citizenship. He now works at a hospital in Plovdiv. As a Bulgarian national, he qualifies as a treaty resident under Article 4(1)(b). He holds ₹20L in Non-Resident Ordinary (NRO) fixed deposits (FDs) at 7% and ₹5L in NRO savings. He is redeeming ₹2L from a ₹12L Indian equity mutual fund portfolio.

How to get your Tax Residency Certificate
You're an Indian in Bulgaria. India needs proof. Here's the workflow from Bulgaria, documents, portal, timeline, the lot.
Who issues it
National Revenue Agency (NRA), Bulgaria
What it costs
Usually free per the NRA; some advisers quote about €50
Timeline
One treaty country, one year
Form 10F / Form 41
Required alongside TRC
Step-by-step for Indians in Sofia
Ask the Bulgarian National Revenue Agency (NRA) for a certificate of residence (udostoverenie za mestno litse) at the NRA territorial directorate office that handles you. The certificate names one treaty country and one year, and certifies residence 'within the meaning of the Double Tax Convention' with that country, so for India it runs into Article 4(1)(b): the treaty only treats Bulgarian nationals as Bulgarian residents. Pair it with Form 41 (formerly Form 10F) at your Indian bank or fund house before the payment, not after.

Things Bulgaria NRIs should know
Pitfalls we've seen Indians in Sofia face
We work with the Indian community in Bulgaria every day. These are the traps that cost real money.
Indian passport holders cannot claim Article 4(1)(b) relief: only Bulgarian nationals qualify. Ministry of External Affairs (MEA) counted 949 NRIs among 1,077 in January 2026. Non-Resident Ordinary (NRO) interest faces 30%, dividends 20%, without the 15% caps. Bulgaria allows only unilateral, per-country foreign tax credit. Bulgarian citizenship opens treaty eligibility.
Use the correct article on Form 41 and bank claims. Dividends are Article 11, interest Article 12, royalties and fees for technical services Article 13, capital gains Article 14, and other income Article 23. Templates citing 'Article 11, interest' point to dividends; numbering runs one ahead.
Check which relief applies. Bulgaria credits Indian tax on dividends, interest and royalties (Article 25(2)(b)); it exempts Indian rent and capital gains India may tax (Article 25(2)(a)). Only Bulgarian nationals qualify. With Bulgaria’s flat 10% rate, 'exemption with progression' has little practical effect.
Apply the 15% cap at source or claim it in your Indian return. India may retain 15% on Bulgarian nationals’ Non-Resident Ordinary (NRO) interest. Bulgaria taxes non-European Union/European Economic Area (EU/EEA) bank interest at 10%, dividends at 5%. Credit clears Bulgarian tax; Bulgaria never refunds excess Indian tax.
Review any credit claim before filing in Bulgaria. Non-Resident External (NRE) interest is exempt in India and taxable in Bulgaria as non-European Union/European Economic Area (EU/EEA) bank interest. Article 25(3) counts tax forgone through exemption as paid, giving Bulgarian nationals an argument for credit on NRE interest.
File an Indian return to calculate your final liability. For Indian passport holders, 30% withheld on Non-Resident Ordinary (NRO) interest is tax deducted at source (TDS). Form 128 (formerly Form 13) can reduce withholding up front. Filing in India matters more than treaty paperwork.
Plan for Bulgarian contributions when an India-based employer posts someone to Bulgaria. India and Bulgaria have no totalisation agreement in force. The Ministry of External Affairs (MEA) lists only a protocol of intent on labour, employment and social security. A certificate of coverage cannot avoid Bulgarian contributions.
Match your Bulgarian calendar-year certificate to India’s April to March financial year (FY) for bank withholding. Bulgaria’s return is due by 30 April. The National Revenue Agency (NRA) certificate covers one year. Use an apostille if Indian institutions request legalisation; both countries are Hague Apostille members.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
TDS on NRO account interest
Right now: 30% plus surcharge and cess
Where it works differently
- A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
- The treaty rate applies, commonly 10-15% under Article 11.
- s.90(2) gives the more beneficial of treaty or Act.
- No PAN is furnished
- s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
- Rule 37BC + settled case law.
- Claiming the treaty rate at source
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That exemption requires TDS at not less than the s.115A rate.
- The account is NRE instead
- NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
- Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
- The deposit is FCNR instead
- The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
- Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62
Commonly got wrong
- NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
- You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
