Athens life, Indian income. Each taxed where it belongs.
The India-Greece agreement predates modern treaty models. India alone taxes Indian interest, dividends, rent and gains (Articles 8 to 11). No cap reduces the 30% on Non-Resident Ordinary (NRO) interest. Article 17(3) exempts this income in Greece. We file returns for excess tax deducted at source (TDS) refunds, arrange Form 128 (formerly Form 13) before property sales, and give your Greek accountant written treaty guidance.
The treaty caps no Indian TDS. A lot of other work still needs a CA.
ITR filing, Form 13 lower-TDS, tax notices, repatriation, treaty relief. That's where we help.

Where Indians in Greecesave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
No significant DTAA rate benefits for Greece. A CA can still help with Section 91 unilateral relief, Form 13 lower-TDS certificates, and ITR filing.
6 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Greece that caps the tax rate on your Indian income. For example, interest is capped at 30% instead of 30%. The difference is legally yours to claim back.

The treaty leaves Indian tax with India. Plenty of real work remains.
Hypothetical: Harjit, 46, is a production foreman at a metal-processing plant in Oinofyta, Boeotia. Originally from Jalandhar, he has lived in Greece for 19 years. He holds ₹15L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings, where rent from the family's Jalandhar shop is received. He redeems ₹1L yearly from a small equity mutual fund (MF). The treaty has no cap, so default and treaty withholding are identical. His savings come from filing the Indian income tax return (ITR) and the Greek exemption under Article 17(3). There is no lower tax deducted at source (TDS) rate.

Step-by-step for Indians in Greece
Apply online on myAADE with your Taxisnet credentials (Registry & Communication, then Tax Residence Certificate). The certificate is issued automatically, in Greek and English, with an electronic seal and a QR code, under AADE decision A.1052/2023. It is free, needs no translation, and can be issued for the current year and earlier years (back to 2014) but not the next year. You make one request per income type, per country, per year. If an Indian bank or registrar wants it apostilled, send the e-certificate to AADE's International Tax Relations Directorate for a wet-ink copy, which is then apostilled by the Decentralised Administration of Attica.

Things Indians in Greece should know
Pitfalls we've seen Indians in Greece face
We work with the Indian community in Greece every day. These are the traps that cost real money.
Claim withholding above slab liability through your Indian tax return. Seek a lower-deduction certificate using Form 128 (formerly Form 13) before property sales. Articles 8 and 9 reserve uncapped taxation for India: 30% on Non-Resident Ordinary interest, 20% on dividends. India-Greece caps of 10% or 15% belong to other treaties.
Cite the 1965 agreement on your Greek return. Articles 8 to 11 and 13 reserve Indian interest, dividends, rent, asset gains and pensions to India. Article 17(3) exempts Indian-source income taxed there. Greek accountants default to worldwide taxation with capped foreign-tax deductions. Exempt income can affect Greek rates (Article 17(4)).
Get a written opinion on Non-Resident External (NRE) interest. India exempts it domestically; Article 9 gives India sole taxing rights, so Greece cannot tax it under that wording. An auditor may interpret Article 17(3)'s 'subject to tax in India' narrowly. Keep your treaty position and NRE statements on file.
Check Indian residence before claiming exemptions. Article 2(1)(f) requires residence in Greece and non-residence in India. There is no tie-breaker. Long visits home or return planning can mean meeting India's residence test that year, losing Greek treaty residence and its exemptions.
Plan for paper certificates early. The free, digital myAADE tax residence certificate (TRC) covers one calendar year, one country and one income type; next-year issuance is unavailable. AADE withdraws it when residence changes. Indian banks and buyers' lawyers requiring paper need a wet-ink copy plus apostille, taking longer.
Check Greek pension rules separately. Greece is absent from India's social security agreement list. Contributions in one country are neither counted nor exempted in the other. Workers posted from India to Greece receive no certificate of coverage. Greek pension rights depend on Greek rules alone.
Greek transfers from Non-Resident Ordinary accounts need online Form 145 (formerly 15CA). Taxable remittances exceeding ₹5 lakh per tax year need prior chartered accountant certification on Form 146 (formerly 15CB), unless an Assessing Officer certificate under section 395 exists. Non-taxable transfers use another part; Rule 220 exceptions need no form.

Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
TDS on NRO account interest
Right now: 30% plus surcharge and cess
Where it works differently
- A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
- The treaty rate applies, commonly 10-15% under Article 11.
- s.90(2) gives the more beneficial of treaty or Act.
- No PAN is furnished
- s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
- Rule 37BC + settled case law.
- Claiming the treaty rate at source
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That exemption requires TDS at not less than the s.115A rate.
- The account is NRE instead
- NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
- Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
- The deposit is FCNR instead
- The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
- Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62
Commonly got wrong
- NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
- You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.
Form 15CB requirement threshold
Right now: Rs 5,00,000 in the financial year, where the remittance is chargeable to tax
Where it works differently
- The remittance is not chargeable to tax
- Part D of Form 15CA only. No 15CB.
- Rule 37BB structure.
- The remittance falls in the specified exempt list
- No Form 15CA at all.
- Rule 37BB(3) specified list.
Commonly got wrong
- Every outward remittance needs Form 15CB. Only where chargeable to tax and above Rs 5 lakh in the year.Form 15CB is needed only where the remittance is chargeable to tax AND exceeds Rs 5 lakh in the financial year. Otherwise Part D of Form 15CA is enough.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
A treaty, but no rate cap.
Plenty we can still do.
ITR filing. Form 13 lower-TDS on property sales. Tax notices, repatriation, treaty relief on the other side. Your Indian tax life still needs a CA who knows Greece.
