Built for Romania NRIsSave 20% on interest

Bucharest is home. Your Indian savings still need watching.

The 2013 India-Romania treaty caps Indian tax on Non-Resident Ordinary interest and dividends at 10% (Articles 11 and 10). Without a Romanian tax residency certificate, banks take 30%; ANAF (National Agency for Fiscal Administration) credits 10%. Use Form Z03 through Spatiul Privat Virtual; submit Form 41 (formerly Form 10F). Article 13(5) exempts mutual fund gains in India. What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Romania that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Step-by-step for Indians in Romania

Romanian residents request the certificat de rezidenta fiscala from ANAF on form Z03 (Cerere pentru eliberarea certificatului de rezidenta fiscala pentru persoane fizice rezidente in Romania). ANAF's official service page lists it as free, with a statutory issue deadline of 45 days from registration of the request; the request can also be filed electronically through your SPV (Spatiul Privat Virtual) account. Apply early in the Indian financial year. Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank or registrar.

Things Romania NRIs should know

Pitfalls we've seen Indians in Romania face

We work with the Indian community in Romania every day. These are the traps that cost real money.

Give your bank a tax residency certificate (TRC) and Form 41 (formerly Form 10F). Non-Resident Ordinary (NRO) interest: Romania credits 10%; 30% withholding leaves 20 points recoverable only through an Indian return. Credits cannot exceed Romanian tax on the same income, assessed separately by country and income category.

Allow for Romanian dividend tax after Indian withholding. For income from 2026, Romania raised its rate from 10% to 16%. India's treaty 10% leaves 6% payable in Romania. India's 20% default withholding leaves 4 points above Romania's 16% that the credit cannot absorb.

Check your 10% health contribution (CASS) band. Cumulative non-salary income (rent, investments, other income) triggers it at 6 gross minimum wages (Romanian lei: RON 24,300 for 2026). The base rises at 12 minimum wages, capped at 24 (RON 97,200). Large Indian fixed-deposit holdings or mutual-fund redemptions can raise it.

Convert Indian consolidated account statement (CAS) and capital gains statement into per-transaction gains for the declaratie unica. Indian-broker mutual fund and share gains face 16% Romanian tax. Only Romanian-resident intermediaries or non-residents with Romanian permanent establishments qualify for 3% or 6% withholding; Indian asset management companies and brokers do not.

Keep proof of Indian tax paid for each year you claim a credit. ANAF (National Agency for Fiscal Administration) requires official documents: Form 16A from the payer and Form 26AS / Annual Information Statement (AIS) from the Indian tax portal.

Declare Non-Resident External (NRE) interest in Romania. India exempts it, while a Romanian resident must report it as foreign interest at 10%, with no Indian tax to credit.

Check your pension category before reclaiming Indian tax deducted at source (TDS). Romanian residents' private employment pensions for past work: Romania only (Article 18(1)). Indian social-security payments, including Employees' Pension Scheme (EPS) pensions: India only (Article 18(2)). Indian government pensions follow Article 19. Category decides taxing rights and refund eligibility.

Questions from Romania NRIs

Everything Indians in Romania ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Romania have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Romania don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
