Built for Syria NRIsSave 20% on interest

Working in Damascus, saving in India. We handle the tax.

The 2008 India-Syria treaty caps Non-Resident Ordinary (NRO) interest (Article 11) and dividends (Article 10) at 10%. Article 13(5) taxes mutual fund units only in Syria. Without Form 41 (formerly Form 10F) and a Syrian residency certificate, banks deduct 30%, refunded by Indian return. Confirm its unpublished process and early 2027 tax system with a Syrian adviser. A Damascus NGO officer's ₹8L FDs save SYP 34,000 (new pounds) yearly.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Syria that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Syria NRI's story

Based on The Indian community in Syria is very small. According to the Ministry of External Affairs (MEA), numbers shrank sharply during the civil war to about 60 Indian nationals as of July 2026. Most are blue-collar workers, alongside a few professionals with UN agencies and NGOs. India maintains its embassy in Damascus, and bilateral trade runs mainly through Indian exports of rice, pharmaceuticals, and textiles., the kind of people in the Indian community in Syria.

He holds ₹8L in Non-Resident Ordinary (NRO) FDs and ₹2L in NRO savings, and is redeeming ₹1L from a ₹4L Indian equity mutual fund portfolio. His bank still deducts 30% on interest because he has never filed Form 41 (formerly Form 10F) with a Syrian tax residency certificate (TRC). Hypothetical example.

How to get your Tax Residency Certificate

You're an Indian in Syria. India needs proof. Here's the workflow from Syria, documents, portal, timeline, the lot.

Step-by-step for Indians in Syria

We could not verify from Syrian official sources which office issues a Syrian tax residency certificate, what documents it needs, the fee or how long it takes. Article 3 of the treaty names the Minister of Finance or an authorised representative as Syria's competent authority, but that is the treaty contact, not necessarily the office that issues certificates. A Syrian tax adviser must confirm the current process before you apply. Ask for a certificate confirming you were resident in Syria under Article 4 of the India-Syria treaty for the period your Indian income falls in. Make sure the name on it matches your Indian bank KYC. File Form 41 (formerly Form 10F) electronically on the Income Tax e-filing portal first, then give your bank the certificate and the Form 41 acknowledgement. Syria is not a party to the Hague Apostille Convention, so if the bank wants a legalised copy, ask the Embassy of India in Damascus how to have it attested.

Things Syria NRIs should know

Pitfalls we've seen Indians in Syria face

We work with the Indian community in Syria every day. These are the traps that cost real money.

Apply early for a tax residency certificate (TRC) with a Syrian tax adviser before Indian FDs renew. Official Syrian sources leave the issuing office, documents, fee, and timing unpublished. Without the TRC and Form 41 (formerly Form 10F), banks deduct 30% on interest instead of 10%.

Claim treaty relief on mutual fund redemptions through an Indian income tax return, since Indian fund houses deduct tax at payout. Article 13(4) lets India tax Indian share gains, while mutual fund units fall under Article 13(5) and are taxable only in Syria. Many CAs miss this split.

Check whether your miscellaneous Indian income qualifies for residence-only taxation in Syria under Article 22. Income that the treaty does not cover elsewhere is taxable only in Syria, except lotteries, races, and gambling. A generic CA often misses this relief.

Send your Syrian tax residency certificate (TRC) and Form 41 (formerly Form 10F) to the company registrar before the dividend record date. Article 10 caps India's tax on Indian dividends at 10%, whereas Indian companies deduct 20% if the registrar lacks your documents in time.

Keep fund source records and ask your bank's Syria rules (this page excludes sanctions compliance). The EU lifted most economic sanctions (May 2025), the US repealed the Caesar Act (December 2025) and removed Syria's state sponsor of terrorism designation (24 August 2026), though some measures and individual listings remain.

Verify whether your Syrian documents state amounts in old or new Syrian pounds. On 1 January 2026, Syria removed two zeros from its currency, making 100 old pounds equal 1 new pound. Salary slips, bank letters, and tax papers from before that date show old pounds.

Ask a Syrian adviser if you qualify under Article 4(1) before using treaty rates, especially at an international organisation. Article 4(1) requires Syrian tax liability by domicile, residence, or similar tests, excluding people taxed only on Syrian-source income (how Syria mainly taxes salaries and business profits).

Contact the Embassy of India in Damascus early for consular attestation of Syrian documents needed in India, as Syria is outside the Hague Apostille Convention. Also plan for separate retirement contributions, since India and Syria have no social security agreement to coordinate contributions between the two countries.

Questions from Syria NRIs

Everything Indians in Syria ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Syria have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Syria don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
