Cairo is home now. Your Indian income still needs care.
The 1969 India-Egypt treaty leaves Indian interest and dividends at domestic rates (Articles 11 and 12), including 30% tax deducted at source (TDS) on Non-Resident Ordinary (NRO) interest. Egypt usually excludes salaried residents' Indian income. Article 19 exempts private Indian pensions in India. We file returns for excess deductions, arrange Form 41 with Egyptian Tax Authority (ETA) certificates where applicable, and obtain Form 128 (formerly Form 13) before property sales.
The treaty caps no Indian TDS. A lot of other work still needs a CA.
ITR filing, Form 13 lower-TDS, tax notices, repatriation, treaty relief. That's where we help.

Where Indians in Egyptsave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
No significant DTAA rate benefits for Egypt. A CA can still help with Section 91 unilateral relief, Form 13 lower-TDS certificates, and ITR filing.
6 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Egypt that caps the tax rate on your Indian income. For example, interest is capped at 30% instead of 30%. The difference is legally yours to claim back.

The treaty leaves Indian tax with India. Plenty of real work remains.
Hypothetical: Rajesh, 44, is a salaried production manager at an Indian-owned garment unit near Cairo. Originally from Tiruppur, he has lived in Egypt for nine years. He holds a ₹10L Non-Resident Ordinary (NRO) fixed deposit (FD) and ₹2L in NRO savings. He redeems ₹1L a year from a ₹5L Indian equity mutual fund. The 1969 treaty sets no rate caps, so default and treaty tax deducted at source (TDS) are the same. An Indian return refunds TDS above his slab liability.
Clean ITR filing
Full schedules (FA, AL, NRI disclosures). Treaty relief claim for any Egypttax you've paid on the same income. Done right, the first time.
Form 13 / Section 197
Selling property in India? A lower-TDS certificate drops your TDS from 12.5% of the full sale price down to the actual gain. On a ₹1 crore sale, that's often ₹15-20 lakh of cash-flow.
Tax notices, end-to-end
148, 143(1), 143(2), 245, 139(9). We draft the reply, file on the portal, attend the hearing, follow up to closure. Under Section 288 authorized representation.
Repatriation (15CA/15CB)
Moving money from India back to Egypt. CA-signed 15CB, Part C filings, bank coordination. Nothing stuck, nothing rejected.
This is what a typical Indian in Egypt with Garment-unit managers and technicians: often ₹5-20L in NRO and NRE FDs, a family home in India and small SIPs. Business owners and senior managers: ₹30L-1Cr across FDs, mutual funds and listed shares, often with a flat in Mumbai, Surat or Chennai. actually needs, treaty or no treaty.

Step-by-step for Indians in Cairo
The Egyptian Tax Authority (ETA) issues residence certificates to individuals and companies resident in Egypt, for treaty purposes. Apply on Form 9 (International Agreements). File it through the ETA electronic tax system, or, if your tax office is outside that system, at the General Administration for International Agreements. You can apply yourself or through a legal representative. The ETA services guide asks individuals for their national ID card, passport, a travel movements certificate, a power of attorney or authorisation with the signature certified by your bank, utility bills (electricity or gas), and a property ownership or lease contract, plus your employment contract. There is no fee. If anything is missing, you get 15 days in total (10, then 5) to supply it, or the case is closed. The certificate is issued within 7 days of a complete application. Residence means a permanent home in Egypt, or more than 183 days in Egypt within 12 months. Egypt's tax year is the calendar year, while India's runs April to March, so ask for a certificate that covers the Indian financial year of your claim. With no rate caps in the treaty, you need the certificate only for a treaty benefit that does exist, such as Article 19, under which a private pension from India is taxable only in Egypt. Then file Form 41 (formerly Form 10F) with the certificate to your Indian bank or payer. Egypt is not a party to the Apostille Convention, so if an Indian bank or registrar wants an attested copy, ask which attestation it accepts before you start.

Things Indians in Egypt should know
Pitfalls we've seen Indians in Cairo face
We work with the Indian community in Egypt every day. These are the traps that cost real money.
Expect domestic deductions: 30% on Non-Resident Ordinary (NRO) interest and 20% on dividends. Articles 11 and 12 set no cap. Recover tax deducted at source (TDS) above your slab liability through Indian returns. Before property sales, seek a lower-deduction certificate using Form 128 (formerly Form 13).
Ask an Egyptian adviser whether Egypt is the centre of your commercial, industrial or professional activity. Salaried garment managers usually fall outside this foreign-income rule. Indian business owners, doctors and consultants in Cairo may fall within. If so, declare Indian interest and dividends; Article 24(2) caps credits at Egyptian tax.
Give your Indian pension payer an Egyptian Tax Authority (ETA) residence certificate and Form 41 (formerly Form 10F). Article 19 taxes private past-employment pensions only where you live. Article 20 allows Indian tax on government pensions, including the Reserve Bank of India, the postal administration and the railways.
Indian shares and fund units remain taxable. Article 14 taxes gains where assets sit; shares sit where incorporated. Equity gains face 12.5%; Egypt exempts them (Article 24(1)). Since 2021, the MLI (Multilateral Instrument) adds a principal purpose test and Indian taxing rights over shares deriving most value from Indian property.
Check accepted attestation formats before sending Egyptian documents or signing a power of attorney in Cairo. Egypt is outside the Apostille Convention. Indian banks, registrars and sub-registrars may require attestation. The Embassy of India in Cairo provides attestation and power of attorney consular services the day after submission.
Expect separate social insurance contributions. Egypt is not on India's list of social security agreement countries. Contributions receive no exemption or cross-system credit. Employees posted from India to Egypt receive no certificate of coverage. Egyptian social insurance follows its own rules.
Match Egypt's January to December year (individual returns due by 31 March) with India's April to March. Get quarterly tax deducted at source certificates, Form 131 (formerly Form 16A). Non-Resident Ordinary remittances use Form 145 (formerly 15CA); where a chartered accountant's certificate is needed, Form 146 (formerly 15CB).

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Power of Attorney executed abroad: the stamping clock
Right now: Stamped in India within 3 months of receipt in India
Where it works differently
- The country is a Hague Apostille Convention member
- Notarise locally, then apostille. Otherwise it needs attestation by the Indian mission.
- Two different routes; using the wrong one means a rejected document at the sub-registrar.
- The 3 months lapse
- Penalty stamping is required and the document may be questioned. Sub-registrars do check the receipt date.
- Indian Stamp Act.
- The PoA is meant to transfer the property itself
- It cannot. A GPA does not convey title, per Suraj Lamp (SC, 2011). A PoA authorises someone to ACT for you, not to receive your property.
- The commonest and costliest misunderstanding.
Commonly got wrong
- A PoA can be used to sell the property to the holder. Suraj Lamp held GPA sales convey nothing. A PoA lets an agent act for you; it does not transfer ownership to them.A Power of Attorney lets someone sign on your behalf. It does not transfer the property to them. Only a registered sale deed does that.
TDS on NRO account interest
Right now: 30% plus surcharge and cess
Where it works differently
- A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
- The treaty rate applies, commonly 10-15% under Article 11.
- s.90(2) gives the more beneficial of treaty or Act.
- No PAN is furnished
- s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
- Rule 37BC + settled case law.
- Claiming the treaty rate at source
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That exemption requires TDS at not less than the s.115A rate.
- The account is NRE instead
- NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
- Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
- The deposit is FCNR instead
- The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
- Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62
Commonly got wrong
- NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
- You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.
Form 15CB requirement threshold
Right now: Rs 5,00,000 in the financial year, where the remittance is chargeable to tax
Where it works differently
- The remittance is not chargeable to tax
- Part D of Form 15CA only. No 15CB.
- Rule 37BB structure.
- The remittance falls in the specified exempt list
- No Form 15CA at all.
- Rule 37BB(3) specified list.
Commonly got wrong
- Every outward remittance needs Form 15CB. Only where chargeable to tax and above Rs 5 lakh in the year.Form 15CB is needed only where the remittance is chargeable to tax AND exceeds Rs 5 lakh in the financial year. Otherwise Part D of Form 15CA is enough.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
A treaty, but no rate cap.
Plenty we can still do.
ITR filing. Form 13 lower-TDS on property sales. Tax notices, repatriation, treaty relief on the other side. Your Indian tax life still needs a CA who knows Egypt.
