Ulaanbaatar is home now. Your Indian savings still count.
The 1994 India-Mongolia treaty caps Indian interest and dividend tax at 15% (Articles 10 and 11). Mongolia alone taxes ordinary Indian mutual fund unit gains (Article 13(6)). Banks deduct 30% on Non-Resident Ordinary (NRO) interest without Form 41 (formerly Form 10F) and a Mongolian tax residency certificate (TRC). Mongolia credits up to 10%. Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
3 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Mongolia that caps the tax rate on your Indian income. For example, interest is capped at 15% instead of 30%. The difference is legally yours to claim back.

Step-by-step for Indians in Ulaanbaatar
Apply online to the Mongolian Tax Administration (MTA): in the e-tax reporting system, open the request menu, choose International tax, then the residence certificate request. The Ulaanbaatar (Capital City) tax office's guidance asks applicants to attach, with a certified translation, the contract or an explanation of which foreign income the certificate is for, so state that it is for Indian interest, dividends or fund gains. The MTA runs an online check of the certificates it issues (etax.mta.mn), so Indian banks can confirm yours is genuine. Keep proof of your days in Mongolia or your Mongolian income, since residence turns on the 183-day or half-of-income test. Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank. India and Mongolia are both parties to the Apostille Convention, so if the bank wants a legalised copy, an apostille should be enough.

Things Mongolia NRIs should know
Pitfalls we've seen Indians in Ulaanbaatar face
We work with the Indian community in Mongolia every day. These are the traps that cost real money.
File Form 41 (formerly Form 10F) with a Mongolian tax residency certificate (TRC). Tax deducted at source (TDS) on Non-Resident Ordinary (NRO) interest falls from 30% to 15%. Mongolia taxes interest at 10% and credits only 10%; 20 points of the default 30% remain uncredited.
Plan for the tax credit gap when comparing Indian deposits with Mongolian ones. India's 15% treaty rate on interest and dividends exceeds Mongolia's 10%, leaving about 5 points uncredited in Mongolia. This gap follows the treaty rules.
Separate gains. Mongolia alone taxes ordinary Indian mutual fund and exchange-traded fund (ETF) unit gains (Article 13(6)); India taxes shares (Article 13(5)). Units deriving over half their value from Indian property the year before sale stay taxable under multilateral instrument (MLI) Article 9(4). Reclaim excess fund tax through Indian returns.
Check both residence tests. Mongolia treats you as resident after 183 days in any 12 consecutive months, or if half or more of your taxable income comes from Mongolia. Count days across that period and check your income; a calendar-year count alone can give the wrong answer.
Budget for Mongolia's 11.5% employee social insurance contribution if you work under a Mongolian contract. There is no India-Mongolia social security agreement, so foreign employees receive no totalisation credit back home.
Check eligibility from 2025. Multilateral instrument (MLI) principal purpose test can deny treaty rates for arrangements mainly seeking them. Article 9(4) lets India tax shares or comparable interests, including trust units, deriving over 50% of value from Indian land or buildings at any time in the 365 days before sale.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
