Built for Indians in Libya

Tripoli pays your salary. India still taxes your savings.

The 1981 India-Libya treaty caps neither interest nor dividends (Articles 9 and 10). Banks deduct 30% tax deducted at source (TDS) on Non-Resident Ordinary (NRO) interest. Libya exempts residents' foreign income, leaving only Indian tax, refundable above slab liability. We file Indian returns, review Form 41 (formerly Form 10F) for private pensions (Article 16) and independent professional fees (Article 12), and obtain Form 128 (formerly Form 13) before property sales.

The treaty caps no Indian TDS. A lot of other work still needs a CA.

ITR filing, Form 13 lower-TDS, tax notices, repatriation, treaty relief. That's where we help.

At a glance

Where Indians in Libyasave, and where they don't

Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.

No significant DTAA rate benefits for Libya. A CA can still help with Section 91 unilateral relief, Form 13 lower-TDS certificates, and ITR filing.

6 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Libya that caps the tax rate on your Indian income. For example, interest is capped at 30% instead of 30%. The difference is legally yours to claim back.

What we still do

The treaty leaves Indian tax with India. Plenty of real work remains.

Hypothetical: Suresh, 46, is a project engineer from Kochi on an Indian passport who has worked on a power project near Tripoli for four years. He holds a ₹10L Non-Resident Ordinary (NRO) fixed deposit (FD) and ₹2L in NRO savings, and he redeems ₹1L a year from a ₹5L Indian equity mutual fund. Because the 1981 treaty sets no rate caps, his default and treaty tax deducted at source (TDS) stay the same. Libya does not tax his Indian income, so filing an Indian return refunds TDS above his slab liability.

Clean ITR filing

Full schedules (FA, AL, NRI disclosures). Treaty relief claim for any Libyatax you've paid on the same income. Done right, the first time.

Form 13 / Section 197

Selling property in India? A lower-TDS certificate drops your TDS from 12.5% of the full sale price down to the actual gain. On a ₹1 crore sale, that's often ₹15-20 lakh of cash-flow.

Tax notices, end-to-end

148, 143(1), 143(2), 245, 139(9). We draft the reply, file on the portal, attend the hearing, follow up to closure. Under Section 288 authorized representation.

Repatriation (15CA/15CB)

Moving money from India back to Libya. CA-signed 15CB, Part C filings, bank coordination. Nothing stuck, nothing rejected.

This is what a typical Indian in Libya with Workers: an NRO or NRE savings account and small fixed deposits, with most pay sent home to family. Professionals such as doctors, nurses and engineers: often ₹5-20L in NRO and NRE FDs, some mutual funds and a family home in India. actually needs, treaty or no treaty.

Form 10F / Form 41

Required alongside TRC

Step-by-step for Indians in Tripoli

We could not verify from any Libyan authority which body issues a tax residence certificate (TRC) to individuals, or its form, fee or processing time, so we do not name one. A Libyan tax adviser must confirm the issuer and process before you apply. In practice the treaty sets no rate caps, so a certificate does not lower TDS on interest, dividends, gains or rent. It matters for the treaty benefits that do exist: Article 16 (a pension for past employment paid to a Libya resident is taxable only in Libya) and Article 12 (fees for independent professional services are taxable only in Libya unless you have a fixed base in India). To claim one, file Form 41 (formerly Form 10F) electronically on the Income Tax e-Filing portal, then give the acknowledgement and the certificate to your Indian payer. Libya is not a party to the Apostille Convention, so ask your Indian bank or registrar which attestation of a Libyan document it accepts before you start.

Things Indians in Libya should know

Pitfalls we've seen Indians in Tripoli face

We work with the Indian community in Libya every day. These are the traps that cost real money.

Expect full domestic tax deducted at source (TDS) of 30% on Non-Resident Ordinary (NRO) interest and 20% on dividends, as Articles 9 and 10 of the 1981 treaty set no bank caps. Libya leaves it untaxed; recover Indian TDS above slab liability via an Indian income tax return.

Pay full Indian domestic tax rates on capital gains and other Indian income. The treaty has no capital gains or 'other income' article, so gains on Indian shares, mutual fund units, and property follow domestic law. Under Article 3, income has its 'tax home' where it arises.

Confirm Libya's tax residence certificate issuer with a tax adviser and file Form 41 (formerly Form 10F). Only Libya taxes private pensions (Article 16) and independent professional fees without an Indian fixed base (Article 12); Article 18 and Article 19 cover students, apprentices, and visiting academics up to three months (extendable).

Check with your employer whether you contribute to Libya's Social Security Fund, alongside Libyan salary tax of 5% and 10%. Resident foreign employees register and contribute only when both employee and employer approve, or under a bilateral agreement. None of this affects your Indian investment income.

Plan your Indian retirement savings separately from any Libyan contributions. Because there is no India-Libya social security agreement, contributions paid in Libya give no credit in India, and staff posted from India receive no certificate of coverage.

Ask your Indian bank, registrar, or sub-registrar which attestation it accepts before preparing an attested Libyan document or power of attorney. Libya is outside the Apostille Convention. Note that the Embassy of India in Tripoli reopened in July 2024.

Track quarterly tax deducted at source (TDS) certificates on Form 131 (formerly Form 16A); Libya uses the calendar tax year, India runs April to March. When moving Non-Resident Ordinary (NRO) money abroad, the payer files Form 145 (formerly 15CA), with Form 146 (formerly 15CB) where a chartered accountant's certificate applies.

Questions from Indians in Libya

Everything Indians in Tripoli ask us

48+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Libya have a tax treaty (called ) that caps this at 30%. The difference, 0%, is money you're entitled to but aren't getting back. Most Indians in Tripoli don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Power of Attorney executed abroad: the stamping clock

Right now: Stamped in India within 3 months of receipt in India

Where it works differently

The country is a Hague Apostille Convention member
Notarise locally, then apostille. Otherwise it needs attestation by the Indian mission.
Two different routes; using the wrong one means a rejected document at the sub-registrar.
The 3 months lapse
Penalty stamping is required and the document may be questioned. Sub-registrars do check the receipt date.
Indian Stamp Act.
The PoA is meant to transfer the property itself
It cannot. A GPA does not convey title, per Suraj Lamp (SC, 2011). A PoA authorises someone to ACT for you, not to receive your property.
The commonest and costliest misunderstanding.

Commonly got wrong

  • A PoA can be used to sell the property to the holder. Suraj Lamp held GPA sales convey nothing. A PoA lets an agent act for you; it does not transfer ownership to them.A Power of Attorney lets someone sign on your behalf. It does not transfer the property to them. Only a registered sale deed does that.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.

Form 15CB requirement threshold

Right now: Rs 5,00,000 in the financial year, where the remittance is chargeable to tax

Where it works differently

The remittance is not chargeable to tax
Part D of Form 15CA only. No 15CB.
Rule 37BB structure.
The remittance falls in the specified exempt list
No Form 15CA at all.
Rule 37BB(3) specified list.

Commonly got wrong

  • Every outward remittance needs Form 15CB. Only where chargeable to tax and above Rs 5 lakh in the year.Form 15CB is needed only where the remittance is chargeable to tax AND exceeds Rs 5 lakh in the financial year. Otherwise Part D of Form 15CA is enough.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

A treaty, but no rate cap.
Plenty we can still do.

ITR filing. Form 13 lower-TDS on property sales. Tax notices, repatriation, treaty relief on the other side. Your Indian tax life still needs a CA who knows Libya.
