Built for Morocco NRIsSave 20% on interest

Casablanca is home now. Your Indian savings still matter.

Morocco taxes Indian interest; credits stop at Moroccan tax. The 1998 India-Morocco treaty caps Non-Resident Ordinary (NRO) interest at 10% (Article 11), dividends at 10% (Article 10). Without a Direction Générale des Impôts (DGI) residency certificate and Form 41 (formerly Form 10F), banks deduct 30%. Reclaim uncredited excess through an Indian return: about DH 7,300 yearly for a Casablanca finance controller's ₹30L fixed deposits.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Morocco that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

He holds ₹30L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings. He is redeeming ₹2L from his ₹8L Indian equity mutual fund portfolio. His bank deducts 30% on interest because he has never filed Form 41 (formerly Form 10F) with a Moroccan tax residency certificate (TRC). Hypothetical example.

Step-by-step for Indians in Morocco

Request a certificate of tax residence from the Direction Générale des Impôts (DGI), Morocco's tax administration. The DGI issues it electronically through its SIMPL online services. Ask for the year your Indian income falls in. Keep proof of your Moroccan home or of more than 183 days in Morocco in a 365-day period. Make sure the name on the certificate matches your Indian bank KYC. Give the certificate to your bank with Form 41 (formerly Form 10F) before the next interest credit. India and Morocco are both parties to the Hague Apostille Convention, so if the bank wants a legalised copy, an apostille is enough.

Things Morocco NRIs should know

Pitfalls we've seen Indians in Morocco face

We work with the Indian community in Morocco every day. These are the traps that cost real money.

Keep Indian withholding within Morocco's credit limit. Article 23(3) caps credit at Moroccan tax. Without a tax residency certificate (TRC) and Form 41 (formerly Form 10F), banks deduct 30%. The 10% treaty rate stays within that credit. Recover deductions above it only through an Indian income tax return.

Check residence over a rolling period. Morocco counts a permanent home, centre of economic interests or more than 183 days in any 365-day period, rather than a calendar year. If India also treats you as resident, Article 4(2) decides by permanent home, then centre of vital interests.

Include Non-Resident External (NRE) interest in your Moroccan income. Morocco taxes residents on worldwide income. This interest is tax-free in India, so there is no Indian tax to credit in Morocco.

Claim India's 10% treaty rate first. Article 10 caps Indian dividend deductions at 10%, while Morocco taxes foreign dividends at 15%. Once your bank applies the treaty rate, the Indian tax should be fully creditable in Morocco.

Confirm fund treatment with a chartered accountant (CA) before your bank or registrar applies it. For Morocco residents, Article 13(6) prevents Indian tax on Indian mutual fund and exchange-traded fund (ETF) unit gains. Indian shares remain taxable in India at 12.5% under Article 13(5).

Recheck property-heavy funds yearly. Morocco's Organisation for Economic Co-operation and Development (OECD) multilateral instrument (MLI) remains unratified (signed June 2019; September 2026 list). The 1998 treaty and 2013 protocol (in force 15 July 2019; replacing Article 26, exchange of information) apply without the principal purpose test or wider property-rich rule.

Check whether other income falls within the winnings exception. Unlike many Indian treaties, Article 22 gives Morocco alone the right to tax other income, including income arising in India. Lottery, race and betting winnings remain taxable in India under Article 22(3).

Questions from Morocco NRIs

Everything Indians in Morocco ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Morocco have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Morocco don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
