Built for Slovenia NRIsSave 20% on interest

Ljubljana pays your salary. India still taxes your savings.

Slovenia taxes Indian interest and dividends at 25%. Its EUR 1,000 interest allowance covers European Union (EU) banks only. The 2003 India-Slovenia treaty caps Indian interest tax at 10% (Article 11) and dividends at 15% (Article 10). Article 13(6) assigns mutual fund gains to Slovenia. What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Slovenia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Slovenia NRI's story

Based on The Ministry of External Affairs puts the community at about 3,000 Indian nationals and persons of Indian origin (PIOs). Most are researchers, students or hospitality workers. A few run businesses. An Indian Association has been set up. The Embassy of India is in Ljubljana., the kind of people in the Indian community in Slovenia.

K

Karthik

33, is a hypothetical postdoctoral researcher at a Ljubljana institute. He has been a Slovenian tax resident for 3 years. He holds ₹15L in Non-Resident Ordinary (NRO) fixed deposits (FDs), a ₹20L Indian mutual fund portfolio and ₹3L in NRO savings. Slovenia taxes his interest at 25% and credits Indian tax at the treaty's 10%. If tax deducted at source (TDS) is 30%, Slovenia will not credit the remaining 20 points. He must reclaim these through an Indian return. His mutual fund gains are taxed only in Slovenia.

How to get your Tax Residency Certificate

You're an Indian in Slovenia. India needs proof. Here's the workflow from Slovenia, documents, portal, timeline, the lot.

Step-by-step for Indians in Slovenia

First make sure FURS has you on record as a resident. Foreigners are usually entered in the tax register as non-residents on arrival, and you must apply to have your resident status determined within 8 days of meeting a residence test (form 'Vloga za ugotavljanje rezidentskega statusa po ZDoh-2: prihod v RS'). FURS decides by a formal decision (odločba). Then request the certificate of residence (potrdilo o rezidentstvu) on the form 'Zahtevek za izdajo potrdila o rezidentstvu Republike Slovenije: fizične osebe', through eDavki, by post, or in person at any financial office. FURS can also certify a foreign tax authority's own form. Pair the certificate with Form 41 (formerly Form 10F) at the Indian bank, and put your 8-digit Slovenian tax number on it. If the bank wants it legalised, an apostille is enough: India and Slovenia are both parties to the Hague Apostille Convention.

Things Slovenia NRIs should know

Pitfalls we've seen Indians in Slovenia face

We work with the Indian community in Slovenia every day. These are the traps that cost real money.

Record residence with Financial Administration (FURS) first. New arrivals normally register as non-residents. Apply within 8 days of meeting a test: registered permanent residence, centre of interests, or more than 183 days. Its formal decision enables the residence certificate needed for India’s 10% interest cap.

Budget for Slovenian tax. The EUR 1,000 deposit-interest allowance covers only Slovenia and other European Union (EU) banks. Non-Resident Ordinary (NRO) and Non-Resident External (NRE) interest attracts 25% from the first euro. NRE interest is tax-free in India, leaving no Indian tax credit in Slovenia.

File Form 41 (formerly Form 10F) and your residence certificate with the bank before interest is paid. Financial Administration (FURS) credits only treaty rates: 10% for 30% deducted on Non-Resident Ordinary (NRO) interest; 15% for dividends taxed at 20%. Reclaim excess Indian tax only through an Indian income tax return.

Declare foreign interest, dividends, rent, share/fund gains separately in eDavki: previous calendar year, by 28 February (2 March in 2026; weekend adjustment). Indian flat sales: within 15 days, unless held over 15 years. Split April to March Form 26AS/Annual Information Statement (AIS) interest/tax deducted at source (TDS) by calendar year.

Check Indian mutual fund holding periods. Article 13(6) assigns gains to Slovenia: 25%, 20% after 5 years, 15% after 10, nothing after 15. Older systematic investment plan units can attract less tax. Reclaim any tax deducted at source through an Indian return. Indian shares remain taxable in India at 12.5%.

Use the treaty documents. Income Tax Department header: 'Date of Signature 2005'. Signed 13 January 2003; in force 17 February 2005. The 2016 Protocol rewrites only information exchange (Article 26), adds tax-collection assistance (new Article 27); rates unchanged. The Multilateral Instrument (MLI), since 2020: principal purpose test; replaces Article 13(4).

Plan for Slovenian social security contributions. There is no India-Slovenia social security agreement on the Ministry of External Affairs (MEA) list. An Employees' Provident Fund Organisation (EPFO) certificate of coverage gives no exemption from Slovenian contributions. Periods are not totalised for pensions.

Questions from Slovenia NRIs

Everything Indians in Slovenia ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Slovenia have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Slovenia don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

EPF withdrawal exemption: continuous service

Right now: 5 years of continuous service

Where it works differently

Service is under 5 years
Four components are taxed separately: employer contribution and its interest as salary, employee contribution previously claimed under 80C reversed, and interest on employee contribution as other sources.
Rule 8 of Part A of the Fourth Schedule.
Employment ended for reasons beyond the employee's control
The 5-year condition is relaxed.
Proviso to Rule 8.
The account is inoperative
Interest continues to accrue and is taxable once the member leaves service.
Settled position; a live issue for NRIs with dormant accounts.

Commonly got wrong

  • EPF withdrawal is always tax-free. Only after 5 years of continuous service. An EPF withdrawal is tax-free only after five years of continuous service. Below five years, four separate components become taxable in different heads.

EPF interest that becomes taxable on high contributions

Right now: Interest on employee contributions above Rs 2,50,000 a year is taxable (Rs 5,00,000 where the employer makes no contribution)

Where it works differently

The member is an NRI with a dormant account
Interest continues to accrue, and an account becomes inoperative after 36 months without contribution, at which point the interest is taxable in India.
EPF Scheme rules plus settled tax treatment.
The member has left India
Indian tax on that interest still applies as India-sourced income, and the residence country may tax it too.
s.9 read with the relevant treaty.

Commonly got wrong

  • All EPF interest is tax-free. Interest on employee contributions above Rs 2.5 lakh a year has been taxable since FY 2021-22.Interest is tax-free up to Rs 2.5 lakh of employee contribution a year (Rs 5 lakh where the employer does not contribute). Above that it is taxable.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
