Built for Slovakia NRIsSave 15% on interest

Bratislava is home now. Your Indian savings still count.

Slovakia taxes worldwide income, crediting Indian tax up to Slovak tax: 19% on interest, 7% on dividends. The 1986 India-Czechoslovakia agreement, with Multilateral Instrument (MLI) amendments from 2020, caps Indian interest tax at 15% (Article 11). Indian rent receives Slovak credit; Indian mutual fund unit gains are taxed only in Slovakia (Article 13(6)). A free Daňový úrad certificate reduces bank withholding. Automotive or information technology portfolio: about €1,100 yearly.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Slovakia that caps the tax rate on your Indian income. For example, interest is capped at 15% instead of 30%. The difference is legally yours to claim back.

A typical Slovakia NRI's story

Based on The Embassy estimates about 11,000 Indians, with sharp growth in five years. Automotive and manufacturing employers include Jaguar Land Rover's Nitra plant (about 300 Indians), Stellantis, Lear, Vertiv, Motherson and DHL. Information technology (IT) staff work at TCS in Bratislava, HCL, Wipro's Capco in Bratislava and Prodapt in Bratislava and Košice. About 500 students study engineering and management in Košice, Bratislava and Nitra., the kind of people in the Indian community in Slovakia.

Rohit

34, is a hypothetical manufacturing engineer at an automotive plant in Nitra. He has been a Slovak tax resident for 5 years on a temporary residence permit. He holds ₹25L in Non-Resident Ordinary (NRO) fixed deposits (FDs), a ₹35L Indian mutual fund portfolio and ₹4L in NRO savings. Slovakia taxes his interest at 19% and caps its Indian tax credit at that amount. The 15% treaty rate is fully creditable. With 30% tax deducted at source (TDS), 15 points would remain uncredited in Slovakia. He must reclaim them through an Indian return.

How to get your Tax Residency Certificate

You're an Indian in Slovakia. India needs proof. Here's the workflow from Slovakia, documents, portal, timeline, the lot.

Who issues it

Daňový úrad (local tax office, Financial Administration of the Slovak Republic)

What it costs

Free (exempt from the administrative fee, per the Financial Administration)

Timeline

Period stated on the certificate

Form 10F / Form 41

Required alongside TRC

Step-by-step for Indians in Slovakia

Ask your locally competent Daňový úrad (tax office) for the potvrdenie o daňovej rezidencii (certificate of tax residence). Use form ZIA51g1v21, the request under section 51g(1) of the Income Tax Act. If you do not file electronically, print, sign and deliver it in person or by post; email is not accepted. Taxpayers who file electronically submit it through their personal internet zone. The office checks your residence facts first, then issues the certificate on paper, on a standard bilingual Slovak and English form, sent by post or collected in person. Pair it with Form 41 (formerly Form 10F) at the Indian bank. If the bank wants it legalised, an apostille is enough: India and Slovakia are both parties to the Hague Apostille Convention.

Things Slovakia NRIs should know

Pitfalls we've seen Indians in Slovakia face

We work with the Indian community in Slovakia every day. These are the traps that cost real money.

Give your bank Central Board of Direct Taxes (CBDT) Notification 25/2015 (23 March 2015), Form 41 and your tax residency certificate (TRC) for the 15% interest cap. Banks and payers sometimes cannot find a 'Slovakia DTAA' (Double Taxation Avoidance Agreement): the 1986 India-Czechoslovakia agreement still applies to Slovak residents.

Plan dividend-paying holdings around the credit gap. Interest is capped at 15%, versus 10% in newer treaties. Individuals get no dividend relief: the 25% treaty cap exceeds India's 20% domestic rate. Slovakia taxes dividends at 7% and credits Indian tax only up to that 7%.

Read Slovak notice 484/2019 for 2020 amendments. The Multilateral Instrument (MLI) replaced Article 23 with credits (MLI Article 5(6)), adding a principal purpose test and simplified limitation-on-benefits clause. The Income Tax Department page retains the original 1986 text, including Article 23's exemption and tax-sparing provisions.

Declare Indian rent and flat-sale gains in Slovakia. Article 6(1) assigns rent to India alone; the Multilateral Instrument (MLI) saving clause in Article 1 preserves Slovakia's right to tax residents. Amended Article 23 credits Indian tax up to Slovak tax. Article 13(1) treats flat-sale gains similarly.

Declare Non-Resident External (NRE) and Non-Resident Ordinary (NRO) interest on your Slovak return. NRE interest is exempt in India. Slovakia taxes residents' foreign interest at a flat 19%, with no credit for NRE interest because India withheld nothing.

Check Slovak residence before requesting a tax residency certificate (TRC). Residence means permanent residence (including a permanent residence permit), a home used beyond occasional stays, or 183 days in the calendar year. Study-only stays mean non-residence, relevant to roughly 500 Indian students: no Slovak residence means no Slovak TRC.

Split Indian interest and tax deducted at source (TDS) by calendar year. Slovakia's January to December return is due by 31 March, extendable by up to 6 months if you declare foreign income. Form 26AS and the Annual Information Statement (AIS) cover April to March.

Posted Indian employees cannot use an Employees' Provident Fund Organisation (EPFO) certificate of coverage. Slovak contribution rules apply. The Embassy's India-Slovakia agreements list, updated after the June 2026 Prime Ministerial visit, has no social security agreement. The June 2026 labour migration memorandum of understanding (MoU) is not one.

Questions from Slovakia NRIs

Everything Indians in Slovakia ask us

49+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Slovakia (Slovak Republic) have a tax treaty (called ) that caps this at 15%. The difference, 15%, is money you're entitled to but aren't getting back. Most Indians in Slovakia don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

EPF withdrawal exemption: continuous service

Right now: 5 years of continuous service

Where it works differently

Service is under 5 years
Four components are taxed separately: employer contribution and its interest as salary, employee contribution previously claimed under 80C reversed, and interest on employee contribution as other sources.
Rule 8 of Part A of the Fourth Schedule.
Employment ended for reasons beyond the employee's control
The 5-year condition is relaxed.
Proviso to Rule 8.
The account is inoperative
Interest continues to accrue and is taxable once the member leaves service.
Settled position; a live issue for NRIs with dormant accounts.

Commonly got wrong

  • EPF withdrawal is always tax-free. Only after 5 years of continuous service. An EPF withdrawal is tax-free only after five years of continuous service. Below five years, four separate components become taxable in different heads.

EPF interest that becomes taxable on high contributions

Right now: Interest on employee contributions above Rs 2,50,000 a year is taxable (Rs 5,00,000 where the employer makes no contribution)

Where it works differently

The member is an NRI with a dormant account
Interest continues to accrue, and an account becomes inoperative after 36 months without contribution, at which point the interest is taxable in India.
EPF Scheme rules plus settled tax treatment.
The member has left India
Indian tax on that interest still applies as India-sourced income, and the residence country may tax it too.
s.9 read with the relevant treaty.

Commonly got wrong

  • All EPF interest is tax-free. Interest on employee contributions above Rs 2.5 lakh a year has been taxable since FY 2021-22.Interest is tax-free up to Rs 2.5 lakh of employee contribution a year (Rs 5 lakh where the employer does not contribute). Above that it is taxable.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
