Built for Namibia NRIsSave 20% on interest

Windhoek taxes your NRO interest. India should take less.

The 1997 India-Namibia treaty caps Indian dividend (Article 10) and interest (Article 11) tax at 10%, leaving ordinary Indian mutual fund unit gains to Namibia (Article 13(6)). Namibia taxes interest, crediting Indian tax. Form 41 (formerly Form 10F) and a NamRA tax residency certificate (TRC) cut 30% Non-Resident Ordinary (NRO) tax deducted at source (TDS), saving a hypothetical Windhoek consultant (₹10L fixed deposits) about N$5,100 yearly. Indian returns refund excess.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Namibia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Namibia NRI's story

Based on Indians in Namibia form a small community. The Ministry of External Affairs (MEA) counts about 65 non-resident Indians in Namibia and records no persons of Indian origin. Because registration with the High Commission in Windhoek is voluntary, the actual number living there may be higher. No verified breakdown by city or occupation is published, so we stick to the official figures rather than guessing., the kind of people in the Indian community in Namibia.

Ramesh

He holds ₹10L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹2L in NRO savings, declaring the interest in his Namibian return, and is redeeming ₹1L from a ₹5L Indian equity mutual fund portfolio. Because he has never filed Form 41 (formerly Form 10F) with a Namibian tax residency certificate (TRC), his Indian bank deducts the full 30% on his interest.

Step-by-step for Indians in Windhoek

Apply to the Namibia Revenue Agency (NamRA) on its 'Application for Tax Residency Certificate' form for individuals, which lists India as a treaty country. Give your NamRA Tax Identification Number (TIN), passport or Namibian ID number, the tax periods the certificate must cover, and tick India. NamRA requires a certified copy of your passport (detail page and all stamped pages), a lease agreement, title deed or mortgage bond, and proof of employment or business in Namibia. It rejects applications from people not registered for income tax, with tax affairs not in order, or with missing documents, so file your returns first. NamRA decides residence under the treaty's residence article, which asks whether you are ordinarily resident or domiciled in Namibia. NamRA does not publish a fee or processing time. Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank and put your NamRA TIN in the tax identification field. India and Namibia are both parties to the Apostille Convention, so an apostille should satisfy a bank that wants a legalised copy.

Things Namibia NRIs should know

Pitfalls we've seen Indians in Windhoek face

We work with the Indian community in Namibia every day. These are the traps that cost real money.

File Form 41 (formerly Form 10F) with a NamRA tax residency certificate (TRC) to cut tax deducted at source (TDS) on Non-Resident Ordinary (NRO) interest from 30% to 10%. Namibia taxes that interest at your slab rate, crediting India's 10%. Claim excess TDS via an Indian income tax return.

Report your Indian interest on your Namibian tax return even though Namibia is a source-based country. Section 15(2) of Namibia's Income Tax Act deems interest received by an ordinary resident to be Namibian income wherever the deposit sits.

Weigh Namibia's section 16(1)(r) exemption carefully. It exempts interest on deposits made and kept outside Namibia using capital entirely from outside Namibia. If you claim it, Article 24(1) of the treaty lets India tax that interest at its full rate because the 10% cap requires Namibian taxation.

Separate fund and share gains. Article 13(6) leaves ordinary Indian mutual fund and ETF unit gains to Namibia (no capital gains tax); India taxes shares at 12.5% (Article 13(5)). Confirm Article 24(1) (limitation of benefits) with a chartered accountant before claiming excess tax deducted at source (TDS) via Indian returns.

Prepare full residence proof rather than a day count for your NamRA tax residency certificate (TRC). Treaty residence under Article 4(1) depends on being 'ordinarily resident' or domiciled in Namibia. NamRA requires your passport with all stamped pages, a lease or title deed, and proof of work in Namibia.

Declare your Indian interest yourself in Namibia, where it faces your slab rate. Local Namibian banks withhold 10% on local interest as a final tax under section 34A(2), keeping it out of your other income. Nobody withholds Namibian tax on Indian deposits.

Request a NamRA tax residency certificate (TRC) covering the exact periods when your Indian interest is credited. You must bridge two different calendars, as Namibia's tax year runs from 1 March to the end of February while India's runs from 1 April to 31 March.

Plan your Indian retirement savings independently of your Namibian contributions. The Ministry of External Affairs (MEA) list includes no India-Namibia social security agreement.

Questions from Namibia NRIs

Everything Indians in Windhoek ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Namibia have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Windhoek don't know this exists.

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
