Built for Latvia NRIsSave 20% on interest

Riga is home now. Your Indian savings still matter.

Latvia taxes residents on worldwide income. Interest and capital gains are taxed at 25.5%. The India-Latvia Double Taxation Avoidance Agreement (DTAA) caps Indian interest and dividend tax at 10% (Articles 10 and 11). Article 13(6) leaves mutual fund unit gains to Latvia. For a Riga information technology (IT) professional, ₹22L in Non-Resident Ordinary (NRO) fixed deposits and a ₹6L fund redemption could mean about €1,040 saved annually.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Latvia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Latvia NRI's story

Based on The Embassy of India in Riga puts the Indian diaspora in Latvia at around 6,000 (June 2026). This includes nearly 3,495 Indian students, mainly studying medicine and engineering. Working professionals in information technology (IT) and business process services are also part of this community., the kind of people in the Indian community in Latvia.

Neha (hypothetical)

32, works as a software test lead at an information technology (IT) services company in Riga. She came to Riga in 2018 for an engineering master's and has been a Latvian tax resident for 6 years. She holds ₹22L in Non-Resident Ordinary (NRO) fixed deposits (FDs), ₹4L in NRO savings and ₹28L in Indian mutual funds. This year, she is redeeming ₹6L towards a flat in Riga. Her bank still deducts 30% from her FD interest because it has never received her State Revenue Service (VID) residence certificate. Her fund house also withholds tax on fund unit gains that Article 13(6) leaves to Latvia.

Step-by-step for Indians in Latvia

Generate the Rezidenta apliecība (Certificate of residence) in the State Revenue Service (VID) Electronic Declaration System (EDS): Izziņas, then Sagatavot jaunu izziņu, then Rezidenta apliecība/ Certificate of residence. An automatically prepared certificate is ready to download at once and carries a QR code and certificate code that anyone can use to check it is genuine. Where VID has to prepare it manually, it issues the certificate within 10 working days, or within one month if it needs more information. Pair it with Form 41 (formerly Form 10F) at your Indian bank or fund house.

Things Latvia NRIs should know

Pitfalls we've seen Indians in Latvia face

We work with the Indian community in Latvia every day. These are the traps that cost real money.

Reclaim excess tax through an Indian Income Tax Return (ITR). Latvia credits only 10% on Non-Resident Ordinary (NRO) interest under Article 23(2)(b), leaving 20% uncredited from 30% deductions. Before the next interest credit, give your bank the State Revenue Service (VID) Rezidenta apliecība and Form 41 (formerly Form 10F).

Declare Non-Resident External (NRE) fixed deposit interest in Latvia. India exempts it, leaving no Indian tax to credit. Latvia taxes interest at 25.5%. The State Revenue Service (VID) requires residents to declare all income from outside the European Union (EU) on their annual income declaration.

Declare quarterly fund gains above EUR 1,000 by the following month's 15th. Article 13(6) leaves mutual fund unit gains to Latvia at 25.5%. First give your fund house the residence certificate and Form 41 (formerly Form 10F), or reclaim Indian withholding through an Indian Income Tax Return (ITR).

Keep proof of Indian tax paid each year. Article 23(2)(a) exempts Indian rent, property gains and share gains in Latvia only after India actually taxes them. Keep Form 26AS, Tax Deducted at Source (TDS) certificates and your Indian Income Tax Return (ITR).

Check when Latvian tax residence began if you stayed after graduating in medicine or engineering. It starts with a declared Latvian address or 183 days in any 12-month period. Your Indian bank needs a State Revenue Service (VID) certificate covering that period before applying treaty rates.

Allow for the 3% additional rate. Latvia adds 3% on the part of total annual income above EUR 200,000. Large Non-Resident External (NRE) interest or fund gains alongside a senior salary can take you over that threshold.

Give registrars your residence certificate and Form 41 (formerly Form 10F) before dividends are paid. Otherwise, they deduct 20% plus surcharge and cess. Article 10 caps Indian dividend tax at 10%. Latvia credits no more than that.

Check social security when your employer sends you between India and Latvia. India has no social security agreement with Latvia. You therefore cannot get a certificate of coverage to stay in one scheme.

Questions from Latvia NRIs

Everything Indians in Latvia ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Latvia have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Latvia don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
