Built for Indians in EthiopiaSave 20% on interest

Addis Ababa is home. Your Indian savings deserve better.

Ethiopia taxes your worldwide income, and credits Indian tax only up to its own tax, with nothing carried forward. The 2011 treaty caps India's tax on your interest at 10% (Article 11) and on dividends at just 7.5% (Article 10). Article 13(6) makes gains on Indian mutual fund units taxable only in Ethiopia. Without Form 41 and an MoR residence certificate, your bank withholds 30% and your fund house 12.5%. On a ₹25L FD, ₹3L NRO savings and a ₹3L fund redemption, that is about Br 130,000 a year of excess TDS, recoverable only through an Indian return.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Ethiopia that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Indian in Ethiopia's story

Based on A small, mostly NRI community: the MEA counts about 2,500, almost all Indian citizens. Its core is in education, with about 150 Indian faculty at Ethiopian universities and higher education institutions, a link going back to the tens of thousands of Indian teachers of the imperial era. The rest work for Indian companies in Ethiopia or for Ethiopian firms that hire Indian staff, mostly in and around Addis Ababa. The earliest settlers came from Gujarat in the late 19th century., the kind of people in the Indian community in Ethiopia.

He holds ₹25L in NRO FDs and ₹3L in NRO savings in Kochi, and is redeeming ₹3L of a ₹15L Indian equity mutual fund portfolio to help with his daughter's college fees. His bank deducts 30% on interest and the fund house deducts 12.5% on gains, because he has never filed Form 41 with an Ethiopian TRC.

How to get your Tax Residency Certificate

You're an Indian in Ethiopia. India needs proof. Here's the workflow from Ethiopia, documents, portal, timeline, the lot.

Step-by-step for Indians in Addis

Apply to the Ministry of Revenues (MoR), Ethiopia's federal tax authority. You will need an Ethiopian TIN (Taxpayer Identification Number). MoR does not publish an online procedure, fee or processing time for an outbound residence certificate, so ask your MoR branch office or a local adviser, and start well before you need it. Ethiopia's tax year runs 8 July to 7 July, while India's runs April to March, so check that the certificate covers the dates of the Indian income. Then give your Indian bank or fund house Form 41 (formerly Form 10F) with the certificate. Ethiopia is not a party to the Apostille Convention, so ask the bank in advance what attestation it accepts.

Things Indians in Ethiopia should know

Pitfalls we've seen Indians in Addis face

We work with the Indian community in Ethiopia every day. These are the traps that cost real money.

Excess Indian TDS is not credited in Ethiopia. Ethiopian law reduces your tax on foreign interest by the foreign tax paid, but not below zero, and unused credit cannot be carried forward or refunded. If your bank deducts 30% on NRO interest instead of the 10% treaty rate, the extra 20 points are recoverable only from India, through an Indian income tax return. Stop it at source with Form 41 and an MoR certificate.

Dividends at 7.5%: Article 10(2) caps India's tax on dividends at 7.5% for every Ethiopian resident, a rare single low rate. Without Form 41 and a TRC, companies deduct the 20% domestic rate. Ethiopia taxes residents' dividends at 15% since 7 August 2025, so with the treaty rate you pay 7.5% in India and the balance in Ethiopia, instead of 20% in India with nothing left to credit.

Mutual funds versus shares: Indian listed shares stay taxable in India at 12.5% under Article 13(5), but mutual fund and ETF units fall under Article 13(6) and are taxable only in Ethiopia. Fund houses will deduct TDS by default, so file Form 41 with an MoR certificate before you redeem, or reclaim the TDS in an Indian return. Ask an Ethiopian adviser how Ethiopia's 15% gains tax treats fund units before you sell.

A two-month deadline, not an annual return: nobody in Ethiopia withholds tax on your Indian interest, dividends or gains, and Ethiopian law requires a tax declaration for such Schedule D income within two months of the transaction giving rise to it, with the tax due on the same date. Ethiopia's tax year also runs 8 July to 7 July, against India's April to March. Keep Form 131 (formerly Form 16A) from your Indian bank each quarter as proof of the Indian tax you are crediting.

NRE interest: NRE (Non-Resident External) interest is tax-free in India, but Ethiopia taxes residents on worldwide income, so it is Ethiopian taxable income with no Indian tax to credit. The 2011 Protocol (paragraph 3) keeps any Indian domestic exemption that beats the treaty, so the Indian side stays at zero.

Pensions from India: under Article 18, a private pension for past employment is taxable only in Ethiopia. Article 19(2) deals separately with pensions paid by an Indian government body. Give the pension payer Form 41 and a TRC so it does not withhold on a private pension.

Selling Indian property: many teachers and professionals in Ethiopia keep a flat in India. The gain is taxed in India under Article 13(1), and Ethiopia can tax it too at 15%, with credit, unless the flat was wholly your residence for the two years before the sale. Form 128 (formerly Form 13) can cut the TDS the buyer deducts, and Form 145/146 (formerly 15CA/15CB) is needed to remit the proceeds abroad.

No social security agreement: India and Ethiopia have none, so there is no totalisation of contribution periods and no certificate of coverage. Ethiopia's private-sector pension scheme (Proclamation No. 1268/2022) covers Ethiopian nationals and, optionally, foreign nationals of Ethiopian origin, so as an Indian national you are outside it. Keep your Indian EPF or NPS position in view.

Questions from Indians in Ethiopia

Everything Indians in Addis ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Ethiopia have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Addis don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

TDS on NRO account interest

Right now: 30% plus surcharge and cess

Where it works differently

A valid TRC and Form 10F (Form 41 from 1 Apr 2026) are furnished
The treaty rate applies, commonly 10-15% under Article 11.
s.90(2) gives the more beneficial of treaty or Act.
No PAN is furnished
s.206AA imposes at least 20%, but Rule 37BC allows escape by furnishing name, address, TIN and TRC. Courts have also held s.206AA cannot override a treaty rate.
Rule 37BC + settled case law.
Claiming the treaty rate at source
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That exemption requires TDS at not less than the s.115A rate.
The account is NRE instead
NRE interest is exempt only while the individual meets the FEMA residence-outside-India condition or is permitted by RBI to maintain the account, and the account is maintained in accordance with the applicable FEMA rules. Income-tax non-resident or RNOR status alone does not establish this exemption.
Income-tax Act 2025 Schedule IV, entry 1 (retaining the earlier s.10(4)(ii) conditions): https://www.incometaxindia.gov.in/w/schedule-iv-4
The deposit is FCNR instead
The exemption covers interest from a qualifying foreign-currency deposit with a scheduled bank whose acceptance of the deposit is approved by RBI, paid to a non-resident or a resident but not ordinarily resident (RNOR) under income-tax law. Check the deposit and residence conditions; FEMA non-residence alone does not establish the FCNR exemption.
Income-tax Act 2025 Schedule IV, entry 14 preserves s.10(15)(iv)(fa) subject to its conditions: https://www.incometaxindia.gov.in/w/schedule-iv-4 ; underlying conditions: https://www.incometaxindia.gov.in/w/section-10-62

Commonly got wrong

  • NRO interest TDS is 30%. Incomplete. Surcharge and 4% cess sit on top, so the effective rate is higher.30% plus surcharge and cess, around 31.2% at the base level.
  • You can file Form 15G/15H to stop NRO TDS. Those are resident-only declarations. An NRI filing one makes a false declaration.Use Form 13 (Form 128 from 1 April 2026), or claim the treaty rate with a TRC.

Form 15CB requirement threshold

Right now: Rs 5,00,000 in the financial year, where the remittance is chargeable to tax

Where it works differently

The remittance is not chargeable to tax
Part D of Form 15CA only. No 15CB.
Rule 37BB structure.
The remittance falls in the specified exempt list
No Form 15CA at all.
Rule 37BB(3) specified list.

Commonly got wrong

  • Every outward remittance needs Form 15CB. Only where chargeable to tax and above Rs 5 lakh in the year.Form 15CB is needed only where the remittance is chargeable to tax AND exceeds Rs 5 lakh in the financial year. Otherwise Part D of Form 15CA is enough.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
