What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Uruguay that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

Step-by-step for Indians in Montevideo

Online, log in to DGI Servicios en Línea with a verified gub.uy account, choose Iniciar expediente and the Certificado de Residencia Fiscal category; or book an appointment at a DGI office (in Montevideo, Fernández Crespo 1534, 8th floor). You must first set up an electronic address (DOMEL). Prove residence for the period requested: for the 183-day test, a Certificado de Llegada from the Dirección Nacional de Migración; for the centre of vital interests, evidence such as school enrolment or health cover. Things Uruguay NRIs should know

Pitfalls we've seen Indians in Montevideo face

We work with the Indian community in Uruguay every day. These are the traps that cost real money.

Declare Indian capital gains from 2026. Uruguay did not tax residents' foreign gains until 2025. Law 20.446 changed this from 1 January 2026: Indian mutual fund, share and property gains attract 12%. With nobody withholding, make six-monthly advance payments to Dirección General Impositiva (DGI) yourself.

Mutual fund (MF) unit gains are taxable only in Uruguay under Article 13(6) from 2026. Protocol paragraph IV lets India tax gains Uruguay leaves untaxed. Reclaim Indian tax deducted at source (TDS) through an Indian income tax return (ITR). Indian shares remain taxable under Article 13(5).

Check whether your mutual fund (MF) gain is taxable in Uruguay. Under Protocol paragraph IV, reduced rates of 6% or 7% under Decree 95/026 leave India no taxing right. A full exemption, or a sale before 2026, means India keeps its 12.5%.

Budget for 12% on Non-Resident External (NRE) interest. India exempts it, so Uruguay's 12% carries no Indian tax credit. On Non-Resident Ordinary (NRO) interest, Uruguay credits India's 10%; you pay the difference.

Keep an Indian tax deducted at source (TDS) certificate for each income item. Decree 148/007 Article 76 bis credits the analogous Indian income tax only up to the Uruguayan tax on that same income.

Before deposits renew, get the Dirección General Impositiva (DGI) certificate. File Form 5202 online or at DGI with an electronic address (DOMEL) and residence proof: Certificado de Llegada from Migración for the 183-day test. Enter your cédula de identidad or Registro Único Tributario (RUT) on Form 41 (formerly Form 10F).

Use an apostille; consular legalisation is unnecessary. Uruguay and India are both Apostille Convention parties. India opened its own embassy in Montevideo on 15 May 2026.

Plan for social security separately. India has no social security agreement with Uruguay. Contribution periods are not added together, and a deputed employee cannot get a certificate of coverage to avoid local contributions.

Questions from Uruguay NRIs

Everything Indians in Montevideo ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Uruguay have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Montevideo don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Treaty rate on Indian dividends

Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10

Where it works differently

A TRC and Form 10F are furnished to the registrar or company
The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
s.90(4) and (5).
The exact rate matters
It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
Never quote one figure across countries.
Claiming the treaty rate
The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
That relief needs TDS at not less than the s.115A rate.

Commonly got wrong

  • The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.

Treaty rate on Indian interest

Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11

Where it works differently

The account is NRE or FCNR
Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
s.10(4)(ii) and s.10(15)(iv)(fa).
The bank refuses the treaty rate without a PAN
Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
See the case register.
The exact rate matters
Per treaty. Do not quote a single figure across countries.

Commonly got wrong

  • All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
