From Hsinchu to Chennai, your Indian taxes kept clear.
For most engineers in Hsinchu or Taipei, Taiwan's regular return excludes Indian fixed deposit interest. Indian withholding: 30% by default, capped at 10% (Article 11) under the 2011 India-Taipei agreement. Dividends: 20% versus 12.5% (Article 10). Article 13(6) exempts mutual fund unit gains. Give your Indian bank a National Taxation Bureau resident certificate and Form 41 (formerly Form 10F). Typical semiconductor engineer's annual portfolio saving: about NT$43,700.

Where Indians in Taiwansave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
2 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Taiwan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Indian in Taiwan's story
Based on This small community includes semiconductor, electronics and hardware engineers around Hsinchu Science Park and the Taoyuan to Taichung manufacturing belt; information technology and fintech professionals in Taipei; doctoral students and postdoctoral researchers at Taiwan's research universities and Academia Sinica's international graduate programme; and a handful of long-settled traders. The February 2024 India-Taiwan labour mobility memorandum of understanding (MoU), signed by the same two associations, may bring manufacturing and other workers., the kind of people in the Indian community in Taiwan.
Karthik
34, is a process integration engineer at a semiconductor fab in Hsinchu, originally from Chennai. He has been a Taiwan resident on an Alien Resident Certificate (ARC) for 6 years. He holds ₹36L in Non-Resident Ordinary (NRO) fixed deposits (FDs), ₹4L in NRO savings and a ₹40L Indian mutual fund (MF) portfolio. He redeems ₹6L a year towards a Chennai flat. His household's overseas income stays well under NT$1 million, so Taiwan does not tax it. India's tax deducted at source (TDS) is his only tax on this income.

Step-by-step for Indians in Taiwan
Apply to the National Taxation Bureau office for your registered address (Taipei, Northern, Central, Southern or Kaohsiung area) using the MOF eTax Portal's bilingual 'Application for Individual Resident Certificate'. The form asks for your Taiwan ID or ARC number, the treaty partner (India), the year and category of Indian income and its payer, any dual residence, your Taiwan dwelling, employer and family residence, and days spent in Taiwan and India in the latest year, with a copy of your ARC and passport as proof. Pair the certificate with Form 41 (formerly Form 10F) at your Indian bank to unlock the agreement rate.

Things Indians in Taiwan should know
Pitfalls we've seen Indians in Taiwan face
We work with the Indian community in Taiwan every day. These are the traps that cost real money.
Help your bank find Taiwan. Show the Income Tax Department's 'Taipei: Specified Associations Agreement' page and Notification 48/2011. The India-Taipei Association and Taipei Economic and Cultural Center agreement was adopted under Section 90A; banks' Section 90 double taxation avoidance agreement (DTAA) lists may omit it.
Keep Indian withholding certificates and annual tax statement for credit. Property sales can trigger Income Basic Tax: household overseas income reaching NT$1 million annually enters basic income. Basic tax is 20% above NT$7.5 million; pay only excess over regular tax, less Indian-tax credit capped at tax added by overseas income.
Count your days before applying, especially after arriving or taking long India trips. Foreigners become Taiwan residents at 183 days or more in a calendar year. The certificate application asks for days in Taiwan and India, supported by your passport.
Check how the receipt is classified before reclaiming 30% withheld by an Indian payer. Article 22 taxes residual income only in Taiwan, except lotteries, games and betting. Expect the Assessing Officer (AO) to check that the receipt falls outside Articles 6 to 21.
Allow weeks for a property-sale power of attorney. Taiwan is absent from the Ministry of External Affairs (MEA) list of Apostille Convention members, so documents cannot be apostilled for India. The power needs notarisation, authentication by Taiwan's Ministry of Foreign Affairs, then attestation by the India-Taipei Association in Taipei.
Check the purpose of any Taiwan holding entity used for Indian investments. Article 28 limitation of benefits denies relief where obtaining agreement benefits was a primary purpose. This rarely affects a salaried engineer with an Alien Resident Certificate (ARC).
Claim an Indian domestic exemption or lower rate when it is more beneficial. The 2011 Protocol (paragraph 1) says domestic law applies where it is more beneficial than the agreement.

The exceptions that change the answer
Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Power of Attorney executed abroad: the stamping clock
Right now: Stamped in India within 3 months of receipt in India
Where it works differently
- The country is a Hague Apostille Convention member
- Notarise locally, then apostille. Otherwise it needs attestation by the Indian mission.
- Two different routes; using the wrong one means a rejected document at the sub-registrar.
- The 3 months lapse
- Penalty stamping is required and the document may be questioned. Sub-registrars do check the receipt date.
- Indian Stamp Act.
- The PoA is meant to transfer the property itself
- It cannot. A GPA does not convey title, per Suraj Lamp (SC, 2011). A PoA authorises someone to ACT for you, not to receive your property.
- The commonest and costliest misunderstanding.
Commonly got wrong
- A PoA can be used to sell the property to the holder. Suraj Lamp held GPA sales convey nothing. A PoA lets an agent act for you; it does not transfer ownership to them.A Power of Attorney lets someone sign on your behalf. It does not transfer the property to them. Only a registered sale deed does that.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
