Built for Fiji NRIsSave 20% on interest

Suva built your life. Your Indian savings deserve better.

Fiji taxes residents on Indian interest and rent, and charges 10% capital gains tax on Indian assets you sell. The India-Fiji treaty caps India's tax on interest at 10% (Article 11) and on dividends at 5% (Article 10). Fiji credits the Indian tax on interest, and normally exempts dividends paid out of taxed company profits. Give your Indian bank an FRCS certificate of residence with Form 41 (formerly Form 10F). The same rules apply to Indian nationals in Suva and to Indo-Fijians with family property in India. For a typical Suva professional's portfolio, the treaty is worth about FJ$1,000 a year.

What is TDS?

Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.

What is DTAA?

Double Tax Avoidance Agreement. A treaty between India and Fiji that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Fiji NRI's story

Based on Fiji's population includes about 300,000 people of Indian origin (37%), mostly descendants of the 60,553 indentured labourers (Girmitiyas) taken to the sugar-cane plantations between 1879 and 1916, plus traders who followed. Most are Fiji citizens with inherited land, family homes or old accounts in India rather than active portfolios. The MEA counts about 2,300 Indian nationals, mainly in IT, finance, education, healthcare and hospitality. Girmit Day is marked each May, with events in Suva and Labasa. Bank of Baroda (since 1961), LIC (since 1956) and New India Assurance (since 1954) operate in Fiji., the kind of people in the Indian community in Fiji.

Step-by-step for Indians in Fiji

Ask the Fiji Revenue and Customs Service (FRCS) for a certificate of residence confirming you were resident in Fiji under Article 4 of the India-Fiji agreement for the year, quoting your Taxpayer Identification Number (TIN). FRCS publishes no form, fee or processing time for this certificate, so request it well before your Indian FDs renew. Give it to your Indian bank with Form 41 (formerly Form 10F). If a legalised copy is demanded, an apostille is enough: Fiji and India are both parties to the Hague Apostille Convention.

Things Fiji NRIs should know

Pitfalls we've seen Indians in Fiji face

We work with the Indian community in Fiji every day. These are the traps that cost real money.

Declare Indian income in your Fiji return. FRCS taxes residents on income from inside and outside Fiji. Indian interest and rent go into chargeable income at resident rates, nil to FJD 30,000, then 18% and 20%, up to 39%. Dividends paid out of profits already taxed at company level are exempt, so Fiji gives no credit for India's 5% on them. Fiji bank interest bears a 10% withholding and stays off the return; if your gross income is FJD 30,000 or less, or you are a qualifying senior or pensioner, apply on TPOS for an exemption certificate.

Budget for Fiji tax on NRE interest. India exempts it; FRCS says income exempt abroad may still be taxable in Fiji, and you get no credit because India levied no tax. A large NRE fixed deposit can push you over the FJD 30,000 tax-free band.

Claim the Fiji foreign tax credit on time. It is the lower of the Indian tax paid and the Fiji tax on that income at your average rate, and the Indian tax must be paid within 2 years after the Fiji tax year. Fiji will not credit Indian tax above that limit. Reclaim excess Indian tax deducted at source (TDS) through an Indian income tax return (ITR).

Plan for Fiji's 10% capital gains tax on Indian assets. It applies to a resident's disposal of a capital asset anywhere, including an Indian flat, shares and mutual fund units. Gains of FJD 30,000 or less and a first residential property or principal residence are exempt. A capital gains tax return is due within one month of the sale. India also taxes the gain under Article 13; Fiji credits it.

Use the 5% dividend cap. Article 10(2) limits India's tax on dividends to 5% for any Fiji-resident beneficial owner. Indian companies deduct 20% unless the company or its registrar has your certificate of residence and Form 41 (formerly Form 10F) in time.

Know which FEMA rules fit you. Any person resident outside India can hold an NRO account. Overseas Citizen of India (OCI) cardholders can buy non-agricultural property and inherit any property. Up to USD 1 million a financial year can leave NRO balances, sale proceeds or inheritances, with Form 145/146 (formerly 15CA/15CB). RBI's Person of Indian Origin (PIO) definition reaches children, grandchildren and great-grandchildren of Indian citizens, foreign-origin spouses, and OCI cardholders; descendants of earlier Girmitiya generations should check which category, if any, fits them.

Get your residence certificate early. FRCS publishes no procedure, fee or turnaround for it. Put your FRCS TIN, 9 or 10 digits, on Form 41. Fiji and India are both Apostille Convention parties, so no consular legalisation is needed.

Keep separate pension records. India's social security agreements cover 20 partners, and Fiji is not one. Fiji National Provident Fund (FNPF) and Employees' Provident Fund Organisation (EPFO) periods are not added together.

Questions from Fiji NRIs

Everything Indians in Fiji ask us

50+ answers. Hover on for plain-English explanations.

Short version: India treats you as an and deducts 30% on your interest by default. That's the rate for “foreigner, no treaty claimed.” But India and Fiji have a tax treaty (called ) that caps this at 10%. The difference, 20%, is money you're entitled to but aren't getting back. Most Indians in Fiji don't know this exists.

The exceptions that change the answer

Where the general rule stops applying to you

Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.

Where it works differently
