Thimphu work, Indian savings. Same rupee, two tax systems.
Bhutan leaves Indian deposit interest, dividends and rent taxable in India alone, without credit for over-deductions. The 2013 India-Bhutan treaty caps interest at 10% (Article 11), dividends at 10% (Article 10). Indian mutual fund unit gains escape both taxes (Article 13(6)). Without Form 41 and Bhutan tax residency certificate (TRC), banks withhold 30%. Hydropower engineer, ₹15L deposits: about Nu. 44,000 lost yearly; up to five past years recoverable through condonation.

Where Bhutan NRIssave, and where they don't
Green bars = your treaty rate. Red bars = what your bank actually deducts. The gap is your money.
3 income types(capital gains, rental, etc.) where the treaty rate matches the default are not shown above. Some treaties include Article 22 provisions for “other income”, eligibility depends on your specific income structure. A CA will confirm which rates apply to you.
What is TDS?
Tax Deducted at Source. Whenever you earn income from investments in India, FD interest, mutual fund returns, dividends. the payer (bank, AMC, or company) deducts tax before crediting your account. For NRIs, this is usually 30% under Section 195, regardless of what you actually owe.
What is DTAA?
Double Tax Avoidance Agreement. A treaty between India and Bhutan that caps the tax rate on your Indian income. For example, interest is capped at 10% instead of 30%. The difference is legally yours to claim back.

A typical Bhutan NRI's story
Based on Most Indians in Bhutan work there rather than settle as families. Ministry of External Affairs (MEA) estimates about 50,000, across infrastructure development, hydropower, education, trade and commerce. They include Punatsangchhu-I engineers and staff on India-backed hydropower projects, construction workers and contractors, science, technology, engineering and mathematics (STEM) teachers recruited by the Royal Government of Bhutan in partnership with India, and border-town traders in Phuentsholing., the kind of people in the Indian community in Bhutan.
Rakesh
41, is a civil engineer on a hydropower project in Bhutan. He has been a Bhutan tax resident for four years on a work permit. He holds ₹15L in Non-Resident Ordinary (NRO) fixed deposits (FDs) and ₹3L in NRO savings. He is redeeming ₹1.5L from his ₹8L Indian equity mutual fund portfolio. His bank still withholds the full 30% on interest because he has never filed Form 41 with a Bhutan tax residency certificate (TRC).

How to get your Tax Residency Certificate
You're an Indian in Bhutan. India needs proof. Here's the workflow from Bhutan, documents, portal, timeline, the lot.

Form 10F / Form 41
Required alongside TRC
Step-by-step for Indians in Thimphu
Bhutan has not officially published how a tax residency certificate is issued: no named issuing office, form, fee, processing time or validity. The Department of Revenue and Customs (DRC), Ministry of Finance, administers income tax, so it is the natural place to ask, but treat that as unconfirmed and check with DRC before you rely on it. You qualify as resident if you are present in Bhutan for 183 days or more in any 12-month period that starts or ends in the calendar income year, with part days counting. Then file Form 41 (formerly Form 10F) with your Indian bank, quoting your TPN. Bhutan is not a party to the Apostille Convention, so if the bank asks for a legalised copy, ask it what attestation it will accept before you start.

Things Bhutan NRIs should know
Pitfalls we've seen Indians in Thimphu face
We work with the Indian community in Bhutan every day. These are the traps that cost real money.
Claim excess withholding through your Indian income tax return. Bhutan taxes only Bhutan-sourced employment and investment income, so Non-Resident Ordinary (NRO) interest earns no credit there. Without Form 41 and a Bhutan tax residency certificate (TRC), bank withholding of 30% leaves an extra 20 points to recover.
Check the investment type. Indian mutual fund and exchange-traded fund (ETF) unit gains: Article 13(6), Bhutan-only taxation; Bhutan exempts individuals' foreign investment gains. Listed Indian shares: Article 13(5), taxed in India. Claim the treaty position on broker-withheld fund redemptions with a tax residency certificate (TRC) and Form 41.
Keep Bhutan returns filed to avoid clearance delays. Rule 213 of the 2026 Income Tax Rules requires tax clearance certificates for residents' foreign remittances above Nu. 300,000 per transaction, and non-residents earning Bhutan-source income before departure. This includes transfers to Non-Resident External (NRE) or Non-Resident Ordinary (NRO) accounts.
Use banks for larger transfers to India. The Ngultrum is pegged to the Indian Rupee (INR) at par, but Indian cash is rationed. The Royal Monetary Authority allows Indian construction workers INR 6,000 a month in cash against a valid work permit.
Use the rules effective from 1 January 2026. Bhutan's new Income Tax Act sets slabs from nil up to Nu. 300,000 to 30% above Nu. 3,500,000. Returns are due by the last day of April. Guidance under the 2001 Act, including its six-month residence test, is outdated.
Confirm institutional approval. Article 19 visiting Indian-resident teachers or researchers teaching at universities, colleges or other approved institutions are exempt in Bhutan on that pay for up to one year from first arrival. Indian fixed deposit interest still needs a tax residency certificate (TRC) and Form 41 for 10%.
Align passport, work permit and Taxpayer Number (TPN) across Non-Resident Ordinary (NRO) Know Your Customer (KYC) and tax residency certificate (TRC) records. Indian citizens may enter Bhutan with Election Commission voter identification (ID), without passports. Indian banks and Department of Revenue and Customs (DRC) need identity and residence proof.

Where the general rule stops applying to you
Every rule below has a carve-out, a cut-off date or a condition that flips the answer. These are the ones that decide real cases.
Treaty rate on Indian dividends
Right now: Domestic rate 20% plus surcharge and cess; most treaties cap it at 10-15% under Article 10
Where it works differently
- A TRC and Form 10F are furnished to the registrar or company
- The treaty rate applies at source. Without them the full 20% plus surcharge and cess is deducted and you recover it by filing.
- s.90(4) and (5).
- The exact rate matters
- It is per treaty, not a single number. Check the country entry. Some treaties are 10%, some 15%, and Italy's dividend article can be WORSE than the domestic rate.
- Never quote one figure across countries.
- Claiming the treaty rate
- The s.115A(5) filing exemption is lost, so an Indian return becomes necessary.
- That relief needs TDS at not less than the s.115A rate.
Commonly got wrong
- The DTAA rate on dividends is 10%. It varies by treaty. Quoting one number across countries is wrong, and at least one treaty is worse than domestic law.Check your country's Article 10 rate, commonly 10% or 15%, against 20% plus surcharge and cess under domestic law.
Treaty rate on Indian interest
Right now: Domestic rate 30% plus surcharge and cess on NRO interest; most treaties cap it at 10-15% under Article 11
Where it works differently
- The account is NRE or FCNR
- Interest is exempt entirely while you are a FEMA non-resident. There is no rate to reduce.
- s.10(4)(ii) and s.10(15)(iv)(fa).
- The bank refuses the treaty rate without a PAN
- Rule 37BC and the Serum Institute / Danisco line say s.206AA cannot override a treaty rate.
- See the case register.
- The exact rate matters
- Per treaty. Do not quote a single figure across countries.
Commonly got wrong
- All NRO interest is taxed at 30%. That is the domestic default. With a TRC most treaties bring it to 10-15%.30% plus surcharge and cess by default. With a TRC and Form 10F, your treaty's Article 11 rate applies, commonly 10-15%.
